Filing K-3 and Using a Financial Co Sponsor

Timeline

I am a US citizen married in and living in the UK for the past 10 years and are looking to move back to the US this year hopefully

We are filing a K-3,I-130 and was advised we would have to have a financial co sponsor as I am not living or working in the US at the present

We have found a financial co sponsor, but we are confused as to use the I-134 or I-864 form?

Hi Pamolly,

It sounds to me like you meet the requirements for Direct Consular Filing (or DCF).

This would result in a CR-1 visa, which uses the I-864. Check out the DCF guide, and also the London DCF wiki.

For DCF, one of the main issues is establishing a domicile in the US. I'm sure you'll find many threads regarding this issue in the DCF forum, as they all have to do it. I don't know too much about it or what has worked for others, so maybe someone else can help you - or since you know some of the key words your own research will be more fruitful.

In addition to Nik+Heaters post - how long have you been married?

If you have been married for longer than 2 years then look at DCF and IR-1. If you've been married longer than two years you can file IR-1 and your spouse would receive 10 year green card upon arrival to the US.

If less than 2 years then CR-1, she would get conditional resident status upon arrival.

Please if I am in error someone correct me!

1/14/2013 I-751 NOA (VSC)

2/07/2013 Biometrics (Buffalo, NY)

Since K3 is dead, you'll be taking the CR1 or IR1 path. You and the joint sponsor each provide an I-864 and supporting documentation but you do it later, not at the time the petition is filed.

If you've been in the UK for 10 years, you are eligible for Direct Consular Filing. It's faster and cheaper than filing via the US service centers (usually takes 4-6 months). Come on over to the DCF forum and feel free to ask as many questions as you like -- we even have our own UK DCF thread.

Don't file anything via one of the US service centers -- you will be submitting all your documentation via the London Consulate. star_smile.gif
