I-864 for CR1 and CR2

So, I'm sure this is in a topic somewhere but the search does not answer my Q's. I get the 2 x petitions = 2 x I-864. This is where we are confused:-

CR1

Q9 - do not include any relative listed on a separate visa petition. So I leave this blank?

Q10 - Enter total number of immigrants. So that makes only 1.

Q21 - 21a = 1, 21b = 1. Add them together makes the household size only 2. Is this correct because there is no provision on the I-864 that I can see where I can list my daughter.

CR2

Same as above which makes the household size 2 again.

Very confused. Anyone who has completed an I-864 both CR1 and CR2, your assistance would be greatly appreciated ... :star:

Common sense tells me that it would HAVE to be 3, on your daughter's form at least.

1 for your USC husband.

1 because he is married, so you're his spouse.

And for 1 for your daughter that he is also sponsoring on the form.

However, your form would only be 2? Did you get RFEd for both?

Let's wait till someone more knowledgable regarding the AOS comes along 'cause I could be totally off-base here.

So, that is what I thought too. I did not get RFE'd - only her.

Anyone? Surely someone's completed an I-864 for a CR2 ... please?? :star:

If that is the case that you got RFEd for your daughter's I864 only, then yes, your form is 2, hers is 3 for the household size.

Hey lady - I know, but her household size is 3 and the RFE reads that is incorrect. The total in 21h does not equal the sum of line numbers 21a through 21g.

Hmm well I just went and looked up my paperwork. I have 3 for both i-864"s on mine a) 2 for yourself and the person you are sponsoring

c) 1 your dependent children under 21

That makes 3 for mine.

For my sons it was a) 2 for yourself and the person you are sponsering

B) 1 for your spouse

That's how he got 3 as well.

I never got any rfe for it, I would call them back and see if someone can explain how they want you to fix it

Maybe they want it to match

Thanks for the help!

We weren't RFE'd on mine for household size so I'm thinking that is what he must do for the CR2 (I actually read all the instructions again and I think I know where he went wrong).

Part 2 - her info

Part 3 - #8 Yes

Part 3 - #9 leave blank

Part 3 - #5 total is 1

Part 5 - total is only 2 (1 for immigrant and 1 for sponsor)

I know I'm his spouse but I'm not a dependent (yet). So he will overnight this today and then we will see if that fixes it. I will have him prepare an updated I-864 for both of us for the interview anyway. Wish me luck ... :star:

OMG I tried but now I know why I couldn't get through - the whole April NVC thread were ringing for interview dates!!

I figure that must be it because her I-864 is currently filled out the way you suggested and the way I thought would be correct. Household size = 3, her - him - and me (as a spouse) ... so if that is incorrect and after reading the instructions technically I'm not a dependent yet because he hasn't claimed me on his taxes.

I can't figure out why she is RFE'd on household size and I'm not?

HOW DO I COUNT HOUSEHOLD SIZE?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, anydependent children under the age of 21,

Took that from the instructions, to me that means to include you, that would be three. yes it goes on to say any other dependent that you had on your recent taxes but just look at it simple. You are his spouse therefor you should be included.

But still call and talk to someone
