When you have the K-1 visa you have to get married within 90 days, and after that you have to file I 130

You do not file for an I130 (petition for alien relative) if you have a K1 visa -- it's analogous to the I129F (petition for alien fiancé(e)) form was filled out for the K1 visa. After marriage, people with a K1 visa file an I485 (adjustment of status). The only time a K1 uses an I130 is if they failed to marry within the 90 days required for the K1, or if it has been an excessive amount of time since POE.

Please review the K1 AOS Guide before advising people about how to adjust status, as if someone had taken you seriously, you would have just wasted $355 of their hard-earned money telling them to file for a petition that is typically not necessary.

Ok guys now I'm even more confused:)

The thing is I need a visa since I'm a Macedonian citizen but I live and work in the Czech republic. Getting a USA tourist visa won't be a problem since I have a good job in an American company so I have a warrantee that I will be back here.

The thing is I really want to visit her this summer so I want to go for a safe option.

At the moment, I'm warming up to the idea of applying for a tourist visa first and at the same time gather all the documents that my fiancée will need for the K-1 visa so we can kick start the process once I return from the USA.

I will also write the USA embassy here and ask.

I was able to successfully obtain a 6 month B2 visitor visa for the purpose of visiting my USC fiance.

The key to this success was the timing. I got it BEFORE my US Citizen (USC) fiance submitted the forms & paperwork for the I129F portion of the process (petition for alien fiance). This is basically the first step towards getting a K1 visa.

I stayed here in the USA with my fiance for the whole time awaiting approval of the I129F. We were able to get all the paperwork and relationship evidence collected together, 'together'!

I actually return to Sydney Australia this Thursday to attend my K1 visa interview at the Sydney consulate before returning to the USA to get married.

Just make sure you are totally honest with the consulate when applying for the B2 and state on the application form that you are visiting your USC fiance. If you hide this fact, they will deny you the visitor visa as they will assume you plan to stay permanently on the visitor visa.

Aha so you are suggesting that I don't need to get back from the USA and then apply? My USC fiancee can apply once I collect the tourist visa. That is cool.

Well the issue is I would just stay 3 weeks visiting her because I have a job that I need to return too so I won't be able to wait the whole time there.

But yeah when I go on the interview I will be honest...

hello,

you should apply for a tourist visa first and not overstay it.After u return to your country apply for a K1 because you cannot enter US while K1 is in process.

I thought you could still enter the US on a VWP while your K1 is going through, if you have proof of returning home

Thankyou Schwez for this informative post. I was just curious about the time period of filing your petition and having an interview back home set up?

I'm traveling for the second time to the US in July to stay with my fiance for the three months permitted on the Visa Waiver program and as he is filing our K1 application mid May I was worried about how rapidly the interview would be set up and if I would have time to make it home to Australia to sit for the interview. You say you were able to do some of the ground work such as providing evidence together in the US? If you have the time to reply I would love to know a little more about how you guys carried this out. Perhaps I should have created another topic but was hoping you might see this more quickly,

Not sure how helpful it is but below is some basic info on obtaining Police Certificates from the countries you mentioned.

As far as documents from your side - for the initial I129F petition, he will only need a G325a (biographic background form) completed and signed by you and a letter of intent to marry signed by you, and passport style photos. Your birth certificate is not required until the interview stage of the process.

MACEDONIA

Overseas apliants apply to the nearest Macedonian consulate in person

You may provide written authorization for someone to act on your behalf in Macedonia

CZECH REPUBLIC

Local applicants apply to the Central registry of Criminal Records in Prague

Overseas Applicants should apply to the nearest Czech embassy

Applicants should provide:
