We just failed our AOS interview last week.

I was in F1 status, but overstayed 2 years before we got married. The officer focused about why I overstayed. Because I overstayed, he tried very hard to confirm I married to be able stay in America. Because my wife doesn't know what's my father's job, and my major, (because she never asked,) that's why. This made the office very mad, at last he said he will treat our marriage a fraudulent marriage and will send out a pending denial letter with reasons and RFE of bona fides marriage , we already included our lease, joint TAX return, letters, rent receipts, car insurance, all with both names on. He also mentioned we can appeal to emigration board if our AOS been denied after RFE.

What should we do now? Will writing to congressman help for our situation?

To me, it sounds like there is a forthcoming RFE letter and the letter should be received, read and responded to accordingly. I'm not convinced, from what the OP is saying, that there is a flat-out denial in this case.

That would make sense unless there is a deadline for AOS filing after 90 days is over. That is if you have a wedding on a 90eth day after POE you still will no have enough time to file.

This stuff is so confusing sometimes. :-(

Well, yer casefile is totally different than the OPs, as well, so I hope things not get even more confused.

IF married within 90 days, is ok to file AOS after that 90 day window.

IMO, you are confusing the mandate of 'get married within 90 days' with some ghostly verbiage to 'file AOS within 90 days' . I'm sorry, there's just no mandate to file AOS within 90 days of I-94 entry date. None.

You know, I don't know exactly what my FIL does either... something to do with silly string, car deodorant trees and stuff like that.. the exact job name or company name... no idea. That said though, I haven't asked. Once I know I'll make an effort to remember, he is family after all.
