I-864 - Example form error?

So I'm finalising paperwork and decide to check the example form to make sure I'm right.. problem is the I-864 example form is wrong... or so I think.

Page 15, 24e is my issue.

24b is where you list household members whose income you are using, and then 24 d and e are where you tick whether they need to complete an I-864A.

Page 7, section 24 (the instructions) specifically where it says "To determine the filing requirements for your relatives included in item 24b, follow these instructions:" is where it discusses whether they need to include the 864A and subsequently which box they need to tick for 24 d and e.

As there is nothing listed in 24b then 24e must be unmarked.

Does anyone else agree or disagree? and if we agree its an error can we have it fixed please?

I'm thinking this could be the reason for a couple of threads I've read where USCIS has asked for the "household members income evidence". While an I-864A wouldn't need to be included in this case, surely tax information etc would be required...

I don't know that it would cause someone to be RFEd for the error - then again, if it was filled out this way, they may think the sponsor meant to include the immigrant's income in 24b.

That said, yes, it's wrong :)

That's exactly what i think.

I can't be bothered looking for it, but there was a thread in the last month or so where someone was REALLY confused by an RFE that asked for "household members income" and they said they'd already sent all the info... but I can't help but wonder if they completed their form the same as the example form then, like you said, they think that you've included the immigrants income and are now want to see it... maybe.. I don't know.. but I still think it would be best if its changed.

I think it depends on if you believe the wording "Person listed above" is referring to anyone listed in #24B (I-864 Part 6) or #2 (I-864 Part 2, the principal immigrant). I've got to think they're referring to anyone listed in #24B.

I filled out mine the same way as the example, and had no issues - with that said, it would a good idea to change it. because you do not need to answer 24E if you didn't use the intending immigrants income.

I haven't read the threads on RFE's concerning this, are they requesting info for the "intending immigrant" because they had 24E checked but not listed in 24B?

Or did the person use household members to make the level, and failed to provide the tax info (they were listed in 24B, but not the intending immigrant)?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I think you're right, that's the issue that i'm having now, I got my RFE as for the petitioner's household member's income which is supposed to be mine, but i wasn't in the list as a household member but I checked the box 24 E, and received the RFE for giving them prove of my work authorization which i never had...

i'll fill out the new form with the UNchecked box and send them. we'll see where it'll get us...
