Bringing Mother and my Brother

Hi Everyone.

Here is my question.

I am a US Citizen and have received my approved I-130 for my mother. I did list my brother, who is under 21 as a dependent on the I-130 application.

I am now waiting for the email from the NVS to pay the fee.

Here is my question.

1, Is it possible for my mother to bring her son/my brother with her to the US under her application for a green card.

2, I have received conflicting answers. The USCIS said that as long as he is under 21 he is considered a dependent and minor and will travel with her.

3, If she can are there any different forms that need to be filled out.

Thanks again to all

Lina

1. No

2. See above

3. No, also see above

You can sponsor your brother, he is in a different category and would have to await a visa number to become available.

ditto to what boiler said.

so really, you haven't filed for your brother. siblings aren't derivatives, so he cannot be under your mom's petition. You have to file for a separate i130 and it takes more than 10 years.
