Hello everyone

i have a question ,what are those possibilities if my husband will not signed the I-864? though he gonna fill up the form.

for sure he told me that he will not signed the I-864 which is the Affidavit of Support. its because one of the page on the form that once you signed the form, you and the U.S government your contracted to them.

the reason he told me is that he dont like to be in contract with the US government.....

please guide me what to do

i really dont know what to say to him i did my best to explain as i can i even told him, why dont u call our friend who had a wife same on my country and same on my visa case and i can even call some of my friends and they can explain u better than i... but i wont talked to them its clear on this documents , and i do understand, one of the words on the affidavit if u wont signed this form the intending immigrant will not be a permanent resident in this country, the thing that ive been worry is that i dont want to stay here as illegal and he told me that believe me they will still grant our petition even i wont signed it.. ok we put like this if ever they approved our petition but i am not a permanent resident , im just still a stranger or alien in this country , he said why? yet we are already married

i really dont know what to do. things are been worse

He is mistaken as the USCIS will require that he sign the I-864. If you are adjusting status based on marriage then he, the petitioner, is your primary sponsor. Without it, you cannot adjust status and will not be able to secure a green card.

If he doesnt not sign it, you will not be able to adjust your status. This means you wont be able to work, and contribute to the household income. You absolutely 100% need the Affidavit signed. There is no option there.

No affidavit, no green card as your spouse is the main sponsor to sign on it. Who had signed on I-134(affidavit) that might to apply to get K-1 visa?

What is the reason why he doesnt want to have a contract with the US goverment? As he is your petitioner and spouse, he is responsible to sign the Affidavit of support I-864. He has nothing to worry about because immigration or government only wants to know if he can support you financially. My husband signed my I-864 and didn't even question about getting into a contract with the government. I hope that he will sign it...

he think once he signed the form , then the US government can access his asset , he just concern with his future and his assets , he never concern on my future

They can only get money from him if you use means tested benefits, and if he believes they will grant you the green card anyway he is severly mistaken. All you will get is an RFE for one that is complete with the signature and if he still refuses you will be denied and can be put into deportation proceedings. I recommend maybe making an info-pass appointment so USCIS can tell him this in person as he apparently won't believe you on this point, but I would tell him if he really loves you and wants you to stay that he will sign the paper.

Also tell him that the contract only lasts until you have 40 quarters of you working OR till you become a citizen. As a spouse of a USC you are eligable for citizenship at 3 years.

Sounds like your husband has lost his reasoning for petitioning for you to join him in the US; he should know that he has forms to sign and should have already understood his obligations (forever).
