Seriously, how is this bloody fair? My husband and I followed the law exactly and we just passed our 6 month anniversary apart with another 2 months at least to go. You break the bloody law, and as a reward, you get to bloody STAY?!?!?!

While I whole heartedly agree with you about how no one should be rewarded for breaking the law (I painfully, and patiently waited for my GC for over a decade, the legal way) I fail to see what 9/11 has to do with this. You know those piece of sh!t evil doers all had valid student visas ?

Sassyandswoop, I hope you really do not mean that. It may not be fair that people can overstay and still get AOS approval, but it is what it is. Not everyone gets an approval. Each case is different. There are a lot of things that aren't fair, and I know this is personal to you (and pretty much everyone on this board). The OP will have the burden on them to prove their case. They will have to be the ones to face the USCIS and explain the overstay if asked. You will not have to worry about this source(the overstay) of frustration, stress, anxiety, etc. because of the AOS path you have taken.

I know we all get frustrated at times, but the OP is not the first to be an overstay and certainly not the last. This isn't the proper way to vent your frustrations in a subforum for those who AOS in a different way than you.

In the light of this thread I'd like to pose the following question.

So, since overstaying for many years, illegally, on a tourist visa is O.K. once you file AOS, why is everyone so uppity about filing AOS 90 days after entering on a legal K-1 visa and legally getting married?

IMO, it's confusion on the instructions.

Specifically the 'other' posters who get confused about that 90 day window, thinking they MUST file for AOS within 90 days of POE date.

For K-1s -

NO ONE is required to file for AOS within 90 days after POE. NO ONE.

They are required to get married within 90 days, and thats it.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

While I still agree that filing for AOS as soon as possible is advisable, it is not imperative!

Bitter much?

Things happen in people's lives. I've never seen one person on here who adjusted from an overstay say they planned to do so.

My husband is one of those people. I'm certainly not going to go into the details of our case with you, but he had an overstay and we adjusted.

The stress was unbelievable and something that you will not understand. Suffice it to say that if we could have done things another way, we would have.

You're using an awfully broad brush to paint a picture of a lot of people you know nothing about. The OP asked for help with her AP, not a nasty judgmental comment.

My husband had nothing to do with 9/11 by the way. I highly doubt the OP did either. I'm glad for you that you're able to play by the rules and do everything the "right" way. Unfortunately not everyone is.

You do know that a mental illness requires a waiver right? :unsure:

Find out the difference between an illegal immigrant (ie one who enters without inspection) and an overstayer. Once you get your head around that one, edumicate the rest of us as to what exactly 9/11 (the perps of which were all legally admitted) has to do with anything other than your frustrations. It is offensive.

Your post may be a vent but adds nothing of value to the valid question raised by the OP.

In answer to the OP I confirm what others have said do NOT leave the USA until your green card is in your hand. The LAW is that "generally" overstay and unauthorised work (with certain caveats) are forgiven upon granting of AOS. I am osrry that you were subjected to the rants of an uniformed person.
