Hello all.

Some small facts. My fiance lives in Canada and I like in the USA(us citizen). I filed for a 129F petition for Fiance back in October 1, 2009. the USCIS sent me an approval letter back on March 18, 2010 and that they are sending the information up to NVC in Montreal to handle processing for K1 visa.

NVC sent my fiance a letter on March 23 asking for her current residency status in Canada in which we she made copies of her Perm. Residence card and return paper work back to NVC on March 31st, 2010 via certified canada post mail.

My question is how much time and more paper work is involved to go from where were at to having her in the USA? is it another 60 or 90 days till consulate appointment? Anyone else go through this in Canada?

thanks for your help

She hasn't received a Packet 3 yet, so I was wondering how long that will take to get. then how long till Packet 4 and finally the interview timeline. is it total 5 months?

It took almost a month to get my packet 3 after my NOA2.

Within that period, from the time NVC sent my case to the MTL consulate, it took a little more than 2 weeks to get it.

See my timeline for a reference... :) you will need to receive packet 3 instructions first, then depending how long it takes you to respond, it will be a few more months til the interview.

Make sure you have all the packet 3 papers ready ahead of time, mine was delayed because of Christmas and money concerns.

What's included in the Packet 3 ? I was informed that it was just a DS-230 forms Part 1 and Part 2. was there more to it ?

I called Dept. of State today and they informed me that US Embassy in Montreal sent out a packet 3 on

MARCH 2nd, 2010. however, Packet-3 was never received by my Fiance in Canada. The question I have is, how can Montreal office send out a packet 3 when the NVC office sent my information to them on March 18, 2010? are they able to start sending packet 3 before then? it seems odd they would pre-send a packet 3 which was never received. I had to send US embassy a request for them to re-mail or send Packet 3 via snail mail. I'm under the impression that this is something she should be getting via snail mail from the montreal office. is that how it works?

btw where is your timeline, I was unable to locate it.

You sure it wasnt April 2nd? that would sound about right to me.

the person on the phone might have just said the wrong month by mistake...

She will be getting it by snail mail... When they say it was sent it means it was sent to the mailroom. So it can take a few more days than what you would expect. Factor in the Easter holiday and she could be receiving it any day now.

First thanks to all who have responded to this thread. Well I called twice to the DoS and talked with two seperate DoS Customer Service(CS) women. The first CS women said March 2nd, 2010 Packet 3 was sent out via mail. I thought hmm, okay that CS person is crazy - so I ended the call with a simple thank you. So 45 minutes pass by, I called DoS again and this time another DoS CS lady answers and she too says the same thing, Packet 3 was sent out via mail on March 2nd, 2010. Did your Canadian fiance not get Packet 3 sir? I said "NO! she did not." I also explained to the DoS customer service lady how is it possible for Packet 3 to be sent out to her when I just recently received a NOA2 letter on March 8 informing us that the NVC would be sending the paperwork to the Consulate office in Montreal where some interview would take place. I found that NVC letter odd too since how can an interview take place when Packet 3 hasn't been received. It's all confusing process with no one at the consulate office to help. anyone else get a similiar letter?

Is it even possible to get an interview without first receiving Packet 3? the only contact we received from Consulate office in Montreal was on March 23rd, 2010, it was a letter asking my Fiance of her current residency status, which she sent back a reply via snail mail next day air signed for on March 30th, 2010.

All in all, the DoS customer service told me to E-mail the Consulate in Montreal and ASK them to Re-SEND the PACKET 3 to my fiance in Canada. I sent an e-mail to them today, but the reply I received back was that they would get back to me in 2 weeks and that any further inquiries would DELAY a response. All were trying to do is to make sure we are given the proper forms to fill and send back on time.

here is my TimeFrame of things so far.

1. 10-01-2009 - USCIS receives I129F Petition for Fiance in Canada (NOA-1).

2. 03-08-2010 - USCIS received letter Petition for I129F was approved(NOA-2), files sent to NVC DoS.

3. 03-18-2010 - Receive a letter that NVC received approval on I129F. Within a week the petition will be forwarded to the approriate visa-issuing post where your Visa interview will take place. MTLxxxx case# given.

3. 03-23-2010 - Montreal US Embassy sends letter to Fiance in Canada requesting proof of status in Canadian residency. She furnishes proof and sends it via Expresspost next day mail.

4. 03-30-2010 - Consulate receives return paper work about Status of Canadian residency sent via Expresspost.

I called DoS on 4-12-10 and was informed Packet 3 sent via mail on 03-02-2010.

No, it doesnt make any sense that they would have sent her pckt 3 before you got your NOA2. I would think it is a typo, a date entered wrong in the system, or something like that.

You need to have returned packet 3 to get your interview. There are several forms for her to fill and they will need that for the interview. At this point, I dont think there is much more you can do... Montreal being backlogged, it is hard to get a response from them. My guess is that the date was entered wrong and the Pckt 3 is on its way.

In the meantime she can look at the forms and gather the info she will need. Make sure she has all the required docs (birth cert., police cert. etc.).
