Hi All, Looking for some advice. A friend of mines wife is from Russia. She had a friend come over on a tourist Visa and we met here in the US. We have become very romantically involved and I want to ask her to marry me. Can we get married before her Visa expires and file for an AOS so she doesn't have to return to Russia?? You are asking for good advice. Fair enough. I ask you: HOW long do you know this woman, the woman you consider to marry? A few days? A few weeks?

Wouldn't you agree that it might make a lot of sense if you got to know somebody from a different continent and a different society a tiny bit better before you pledge to spend the rest of your life and money with her and jump into the cold water of a long, expensive, and painful immigration procedure?

It can't help but feeling a bit weird about such a hasty decision. Getting married is not like buying a new car which, if you find out it's not as good as you thought, just sell again or trade in for another one. Why don't you have her visit you again, or you visit her first and experience life in Russia with her, at least for a week or so?

I agree with a poster above. You should really get to know her first. Because if you marry her it means you will be stocked with her for a long time if something goes wrong, you will mess her life and your own as well,I'm not even talking about nervous and money that you will have to spend. It is not that easy as it looks.

I would suggest to educate yourself about the whole process and positive/negative outcome.

Thank you for the good advice.. On a side note I have dated Russian woman before and have been to Moscow three times.. I understand the culture very well and was not looking for something so quickly but my understanding is if she goes back then there is a whole detailed procedure that could take up to a year to get her back??

I guess I am just wondering if we decide to go through with the marriage what is my first steps after?

The right thing to do is to marry her while she is in the US and send her home. It's not advisable to try to adjust status from a tourist visa.

The best thing to do is get married, go back to Russia and file for CR1.

Look, legally (the way the situation was explained by the OP) if they got married, they can go through the AOS process while here because the friend came over to the us on a visitor visa without prior intent (again, we may all have differing opinions or not of if this truly was without intent.. but that's not for us to judge). Please don't come over to the AOS from Work, Student, & Tourist Visa section and tell people to go the CR-1/IR-1 routes just because it's the way you did it or think it's the only "right" way to do it. We don't know everything about their situation and only know what the OP has told us.

Now after saying that, I agree with some of the posters about it sounding kind of hasty with the whole never having met/talked to the person until you meet them while they are over on the visitor visa and wanting to marry them so they can stay here... It raised a red flag in my mind (but I'm not an employee of the USCIS).

We just bought a new car last night and OMG it felt like life and death to me. Getting married was a far less stressful situation for me. I knew what I was getting with Kyle. :luv:

I've had this discussion here many times and it came down to this. Some people fall in love, look up what they need to do, go by the rules and live happily ever after. While other people are more spontaneous. The first group of people tends to not like the second because they see them as cavalier and irresponsible. I'd even go so far as to say that they see them as bad elements of society that skip rules and take advantages of situations.

But the fact is that not everyone is the same. And the fact that you can marry here and file from here, or marry here, overstay and then adjust, shows that USCIS recognize this. I, for one, think it's amazing. Not because I am one of the people who married, overstayed and adjust. No, but because it shows that USCIS understands that not everyone is the same and not every situation is ideal and text book.

Marrying someone after a few weeks or a few months may seem extreme and maybe it is. We do not know the whole story, but they have options open to them. Some are less popular than others, but those options are still there.

See what visa she holds. If is a B1/B2 multiple entry visa, she can leave to Russia just before the I-94 expires and come back a week/month later to visit you again.

If you are in love, get married and file for AOS.

Legally, there is nothing to stop you.

There are people who meet the right person and that's it for them. So, if you are that type, do not listen to those who tell you that you should know someone for a year before marrying them. Long courtship does not guarantee success in marriage.

You CAN marry her while she's here on a tourist visa but the tricky part with attempting AOS is convincing the interviewer is that she didn't come here on a tourist visa with the INTENT to stay.

Your best bet if you've decided to get married is to have the ceremony and have her return home to Russia, then file the CR-1.

They never met until she came to the US. How could she intend to marry and stay???

Anyhow, even if they marry and then she leaves, they should apply for CR-1 immediately after marriage, not after she returns to Russia.

You CAN marry her while she's here on a tourist visa but the tricky part with attempting AOS is convincing the interviewer is that she didn't come here on a tourist visa with the INTENT to stay.

Your best bet if you've decided to get married is to have the ceremony and have her return home to Russia, then file the CR-1.
