Timeline

I have a K-1 visa and I'm trying to fill out the Application for a Social Security Card. I'm wondering about question 5 on the form (Citizenship). Should I mark "Legal Alien Allowed to Work" or "Legal Alien Not Allowed To Work" since I don't yet have my EAD.

Well i went to the social security office and they told me i didnt need to fill anything up. They just asked me questions on the spot and that was that. And after that, they mailed me the card.

Which SSA office did you go?

phoenix, arizona. They said that i dont need to fill out anything anymore, its easier now.

I assume that was at one of the Card Centers in Phoenix? You only need the SS-5 when the application is mailed in, or someone takes it into the office for you. This only works for a replacement card or name change applications, since everyone age 12 and older applying for an original SSN and card must apply at the office or Card Center in person.

As I have said many times, when you apply in the office you don't need to provide a Form SS-5.

That is new system now? I provided SS-5 when I applied. But they didn't issue SSN to me until my I94 was going to expire. And they just send a letter to me stating that my I-94 is going to expire and they can't issue a SSN card unless I bring my adjusting status document to show them. But that letter also said that doesn't mean I am not ineligible for SSN.

(I gave them over 7 weeks window)

3. Systems-Generated Application

FO employees use the NY SS-5 Assistant Release 2 in conjunction with MES (or MES on PCOM when an exception to using the NY SS-5 Assistant exists) to input and process an application for an SSN card. The systems-generated application will collect and display the same information that is collected on the Form SS-5. When the applicant remains in the office throughout the interview and keying of this data, the FO employee must print the systems-generated application for the applicant's review and signature, and the FO employee(s) certification(s).

-- request the applicant to sign the systems-generated application (even if the applicant had brought in a completed paper or Internet Form SS-5)

-- keep the signed systems-generated application in the holding file for later shipment to the SSA Records Center (RM 00204.065); and

-- destroy (i.e., by shredding) any other versions of the form that may have been completed once the systems-generated application has been signed. NOTE: the other form may be returned to the applicant, if he or she wishes to keep it.

So even though you might have gave the SSA office a Form SS-5, it went it the trash.
