Well, he could re-forward the email to the congressional liaison unit and be a bit more proactive. Mine followed up with emails and called and while she did tell me it takes them up to 30 days to reply by law, she got the emails back in 2 business days.

well thats good to know. i think i will bug him again next week.

K1 visa

K1 Visa process took about 1 year, got married on January 13, 2006.

Got my green card on October 5, 2006.

Removal of Conditions

September 15, 2008: I-751 package sent

November 1, 2008: Received NOA

Januar 13, 2009: Biometrics appointment in Buffalo

May 2009: Notice of case transfered to California

August 3, 2009: received RFE letter; sent in evidence 2 weeks later, USCIS confirmed reception

March 03, 2010: Filed form DHS-7001 with CIS Ombudsman, and contacted my local Congresswoman to try to get my case pushed through.

June 5, 2010: Letter from CIS Ombudsman telling me USCIS is not ready for a decision yet. They didn't give me a timeline for when to expect a decision... this is getting worst...

August 2, 2010: Infopass appointment for I-155 stamp in my passport. Agent who helped me is going to get my file from California and process it himself!

August 10, 2010: Email from my Congresswoman's office, USCIS still not ready for a decision, told to wait another 90 days. And email from agent at local office telling me that his request to get my file was denied by California...

When you go to infopass again, soonish, initiate a 'service request'.

This forces USCIS to find the file, and report back to you exactly 'where it is' and in what timetick on status.

I also understand that a immigration liason staffer at a congressmen's/senator's office can ALSO instigate a service request on yer behalf.

Know just what you are going through. I went for an infopass appointment on Thursday and was told it can take up to two years. there is no rush because even as a conditional resident you still have all the benefits of residency as opposed to 1485 applicants who do not. As a result there is no need for expediant processing of i751. I was soo annoyed and felt so brushed off that I tried to get back into the office and speak with someone who wouldnt tell me to shove it for two years. But unfortunately once they log you in your appt is over. I felt so powerless.

Hi Rising Spring and Everyone,

I can definitely understand your frustration here, in waiting for your I-751 to be approved (wow, 1 1/2 years is certainly a long time to wait! :o ), as "I've been there, done that", with this stage of the immigration game....

(lol..I'm beginning to think that the USCIS has this thing against Canadians or something...lol..)

For my I-751 case, it took 10 months for it to be approved (which is far more than the 6 months of service expectations)

And this was after 4 expedites/inquiries and a passport stamp, including 2 inquiries that involved getting my congressman involved....

Lol..I'd still be waiting now, if they didn't intervene!

Oh and to add insult to injury, I was pregnant at the time..

And it was quicker for the baby to arrive in 9 months than it was to get that green card in 10 months!....

Overall, I ended up having the 10yr card for only 5 months, despite having to wait 10 months for it!

Still makes my blood boil too...(even though I don't have my card anymore since they took that away and I'm a US Citizen...lol...)

If I were you, I would make an infopass with the USCIS to further inquire about your case. If that doesn't work, my suggestion is to take your case up to your local senator/congressman/ombudsman to get your case further investigated and eventually approved. Political influence does help here..lol....:thumbs:

Also, you might want to consider taking the USCIS to court, since it has been so long in your case....

As well, if you are able to file for the N-400/US Citizenship, when you meet all those requirements, by all means, go for it! This will "force" your I-751 to be approved so that your N-400 can be approved too. Note too, that as a Canadian you can keep both your Canadian citizenship and American citizenship, with no problems.

Those who get approved quickly and without incident at this I-751 stage of the game are lucky. But who knows, maybe you'll have better luck in the N-400 stage, to make up for the delays and problems you had with the I-751. Lol..I know it did for me, as I got US Citizenship very quickly in 2 months (average wait is 4-6 months). Guess that made up for the I-751 delays and problems for me, and maybe for you too if your citizenship is approved quickly and get lucky there.

Don't give up! There is hope..... :):thumbs:

P.S. To the OP-By any chance, did you move? I couldn't help but notice that your AOS timeline was in Buffalo, NY...but your new timeline is in Philly, PA...

Perhaps the moving delayed your ROC application too? :unsure:

my timeline is in my signature, i filed for removal of conditions back in september 2008!

last fall when i had not received my green card yet i called USCIS, asking them to email on my behalf to have my case pushed through. immigration sent me a cookie-cutter letter 2 weeks later saying they didn't know yet but that i would receive a decision or NOA within 45 days. i didn't, so i called them again, and i then received another letter saying my case had been given to an adjudicating officer and to wait another 45 days. i waited and nothing, so i called again, same thing, they sent me another letter on february 22nd this time saying to wait 90 days and if i hadn't heard from them to call them !*&%#$?

HOW MUCH LONGER DO I NEED TO WAIT??

i am getting really impatient. i have sent form DHS-7001 with CIS Ombudsman to ask what is up with my case, i have had my congresswoman send in a letter for me. i have had to get stamps in my passport twice in order to be able to travel, my latest one is about to expire, i need to take another 2h trip to my nearest office to get another stamp. i am sick of this!!

has anyone else experienced this and have any words of wisdom?

Selective reading? rising spring clearly stated she is not interested in naturalization. Her only other option is to get her congressman working on this issue.

Milimelo-Yes, US citizenship is OPTIONAL. I just mentioned about such and option as a way to speed up the I-751, as the OP's concern was about speeding up the I-751 case, that's all. In the end, it is up to the OP to decide as to whether or not they want US citizenship, as again..it is OPTIONAL.....;)

I thought I would also mention too, that as a Canadian, the OP will not lose their Canadian citizenship if they decide to pursue American citizenship. Not sure if this is any help at all, but at least the OP can be aware of this fact.....

And to the OP...Good luck with your I-751 case! Don't give up! :thumbs:

i already initiated two service requests via phone with the USCIS in the last 6 months. twice they simply sent me stock letters in the mail telling me my case wasn't read for an answer. i plan on calling again soon. the last letter i got, in late february, asked me to wait 90 days for an answers. i am not expecting much.

heard from the congresswoman's case worker today. he said he hasn't heard back and that sometimes it can take months. i asked him about the USCIS having a timeline for answering requests from congress people, and he said no, they are slow, nothing he can do. :wacko:

my current concern is that my biometrics will be expiring in a few weeks. someone here on VJ told me that in itself might be enough for them to send me a decision before then. if not, does that mean they will be sending me another appointment for biometrics soon? are they required to have current biometrics on file?

I don't know about being 'required' to have current biometrics on file, but they may well want a new one from you if it's been over a year since your last one when they FINALLY get around to adjudicating your case.

I'd be inclined to contact the USCIS ombudsman's office too. Can't hurt at this point.

yup i already filed with DHS ombudsman. i was told that was pretty much useless though in the grand scheme of things.

i'm currently having my canadian passport renewed, so as soon as i get it back, i will need to get another stamp in my passport. so off to infopass i will go, maybe they will have something to say!

oh and to the person who mentioned moving, i haven't moved since filing for removal of conditions. i originally filed through Buffalo, did biometrics there. because i live in Erie PA, but for infopass i have been going down to Pittsburgh instead.
