Guys my wife is in Pakistan and expecting a baby in October(Inshallah).

As I become eligible to apply for citizenship in December, how do we go about the immigration for the newborn.He/she will likely be 6-8 months when the family finally immigrate.

Will the baby need a new pak passport to travel or will he/she be registered in mom's passport?

How long before the baby acquires US citizenship?

Anyone having similar situations to share?

Thanks.

This is a 'slippery date' thing, IMO.

If YOU are a US Citizen at the time of the child's birth, and meet the 5 year rule,

then the baby will be a US Citizen by birth, and you'll need to file a CRBA at the Consulate.

If YOU don't meet the requirements, then the baby will be classified as a 'foreigner' and you'll need to file a new I-130 on the baby, at USCIS, the Chicago Lockbox.

If you've not filed anything yet, if you are holding out until you get your USC status, then it will be easier on you three - it's two I-130s, filed at the same time.

I-130 for wife has already been approved.Whats the fee for the baby?Is it the same as the one for adult?Once in US,does the baby get the citizenship any faster?

IF you qualify for CRBA (Consulate Record of Birth Abroad)

then 'that' can be handled at the Consulate/Embassy - not sure of the price for filing - usually under 200 usd.

IF you don't qualify for CRBA because of the 5 year rule for Citizens domicile (you better check into this, immediately ) then you'll have to file a NEW I-130 at the lockbox address in Chicago for the baby. (355 + 70 + 400 + any medical fees ) and be prepared to wait 6 to 12 months from initial filing date.

Good Luck !

Should I file I-130 as LPR or wait 3 months and file as US citizen?

Does it make any difference to the processing time?

ya, - YER status makes a difference on the processing time, you betcha.

Seriously, study the requirements for citizenship domicile as it pertains to CRBA, see if you will qualify after you have been granted USC or no.
