Normally, when you're deported because of overstaying a visa that will be the only thing listed on the paper even if there are other inadmissibilities. There was no need to "fix things" in our case because all inadmissibilities listed by the consulate(frauduelent entry and visa overstay) were correct. You can attempt to get the paper, but i don't think it will be helpful. The consulate can tack on other inadmissibilities any time they are discovered, and they do not have to be listed on the deportation documents. Since there seems to be an error in your case, you need to work very hard to prove that this is not true. This needs to be done with police records and documents related to your deportation. I think someone mentioned an FOIA which is good, but be warned they take about a year.

He was able to come back after filing 601 and 212 waivers, but it was a very long process.

So I got a phone call from that nice lady ( CO)at the embassy she told us that when she took my finger prints they came out nothing i have nothing even the FBI came out ZZZeroooooooo so basically we are ok but she said that the mistake is from 1997 That ICE made and she rquested those deportion papers cause she said that she didnt find on the system any thing it says the ammount of drugs that they are accusing me of being deported for it so she began to think that we are making sense and she allso said that its gonna be a long time until things get fixed she said that we need to fight and we might need a lawyer and she will help as much as she can i dont know why the system in america like this each dep work on their own and they dont report to each other iam so mad and now its gonna cost us more money to hire a lawyer and i know that we cant afford it right now.

by the way she is leaving in August but she said she will do her best to get things done and she said she is sending a new paper to us saying that they ar looking into our case so its better than the other paper i got saying i was deported for dugs....................

If you were deported I am confused as to why no one has ever told you you need a waiver. Am I missing something? It would seem, at the very least, that you need a waiver for the deportation and, depending on how long you overstayed your visa and how long ago it was, perhaps for that as well.

There was an error and they have confused him with someone else. The embassy now realizes

that there was a mistake, but ice has to clear it up on that end.

He stated that he was not deported for drugs. He said he was deported in 1997 for overstaying a visitors visa. Rereading everything, I think he received a 10 year bar and that 10 years have since passed so he should be eligible without a waiver. If the woman at the consulate has confirmed this (and realized he had no drug charge against him) it should not be that difficult to fix. If there really is no there no other problem--and no waiver needed--what is stopping them from being able to issue the visa? I think it is worth posting on the waiver forum to see if there is anyone else who has successfully corrected a mistake like this on the part of the Consulate and what the procedure was.

Samer, thats great news that the lady at the consul is trying to help! At least she used some common sense to see the story. I hope you can get through this quickly and without a lawyer.

I think JPaula has a good suggestion to try and post in the waiver section to see if anyone else has had this experience of straightening out a mistake made by ICE.
