Timeline

Hi,

I'm US Citizen, I have been laid off for a year and half. My question is: Can I marry my future lady and sponsor her without having job? she's here on F1 visa,and it possible the USCIS denial my application for AOS because I'm not working? I do have decent saving account though, beside my unemployment benefit.

Any help will be appropriated!!

You don't need to be working to get married but without an income it could be challenging to sponsor her - you might need a co-sponsor if your savings/UI benefits were not sufficient.

To answer your question - it is possible to be denied if insufficient sponsorship can not be obtained.

You haven't provided much in the way of details. Check out the form I-864 and the instructions for using assets to meet the requirements.

In order to use assets, you must be able to prove that they are worth 3x the income shortfall. I'm really not sure about unemployment as income - I have read conflicting things about it - on one hand it's not always considered reliable income (may end) on the other hand, you have to pay taxes on it, soooo....

If your fiancee is working (Can you work on F-1? I am not familiar!), you can include her income.

Otherwise, look into a joint sponsor. That's also covered in the instructions for the I-864.

December 23, 2009: NOA1!

I worked last year and still didn't make the required amount to sponsor my wife alone. I had 3 dependents including my wife. 4 Counting myself. USCIS requires i think you make 27500.00 in a year to be the sponsor with 4 people. (I BELIEVE. NOT 100% THOUGH. I JUST KNOW 22000.00 Wasn't enough.) I had my Step mom co-Sponsor me and my wife. It doesn't have to be a family member. It could be a friend or anyone who made the required amount to be a co sponsor and someone who will trust you with the same the USCIS asks from you. Like i was required to have a COPY OF MY LAST 3 MONTHS CHECKS, LETTER OF EMPLOYMENT, LAST FILED TAX RETURN AND W-2. YOUR CO SPONSOR HAS TO HAVE THE SAME THING. My step mom was more than happy to help us. She went through this same process with her first husband who was from Brazil. I hope my information was helpful.
