My wife is petitioning her parents. We've already paid the AOS fee of $70 and also received "Paid" status for the $400 IV fee. We're running a little late on filing the I-864 Affidavit of Support but her parents are still waiting on their passports anyway. I'd like to remain off the AOS if possible but I'm willing if I need to do so. It's only my wife and I in the household and she's petitioning both parents.

What is her salary requirement? Would it be figured at 125% of the poverty line for 2 people, 3 people, or 4 people? Is there a link to a 2010 I-864P or is the 2009 form linked here still current?

The count would be 4. (your wife, spouse (you), two parents) - $27,562 would be the level.

The 2009 poverty level is still in effect. (It will be changing in the Spring of 2010 - unknown the exact date)

If you are going to use your income to help make the level, you would fill out an I-864A.

You can make a copy of these forms (864/864A) if both parents are listed on them (one original, one copy) to put to the two different submissions.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
