Ok so most of you know my story, went for my interview on 8th of Feb and they requested more documents.. my Daughters CRBA and my co-sponsors 2008 tax information.

My mother-in-law is our co-sponsor and her accountant sent her 2008 taxes to me. I emailed MTL to see if it was the right thing and they never emailed me back. So we went ahead and sent it off a few weeks ago.

I called the DOS this morning and she said that they havent even received the additional documents yet, and anyway are going to want her 2008 tax transcripts from the IRS, not what her accountant gave me. Surely her 1040's from the accountant would be good enough?? Im beside myself right now, if this is seriously the predicament we are in then I dunno... this sucks so bad.

Please someone let me know what they think.. are her 1040's from the accountant good enough?

Thanks,

Coralie

It's not hard for your MIL to get her tax transcript from the IRS - took us abotu a week to receive by email. Have her do that and then maybe fax to you.

Anyone have the IRS tax transcript # handy?

I would send your mail with some sort of tracking, will give you piece of mind and some reliability.

I did send it via expresspost, and when i track it it says "delivered". So I dont know why DOS says it hasnt been received yet.

You haven't mentioned if you sent slips as well, but that is key. There is no reason why they would not accept a 1040 with slips.

If you really want a transcript, they will fax it. Now not much use faxing it to your cosponsor, but she could request that it be faxed to you. If you don't own a fax, you could contact some place like staples or office depot and get a fax number from them, or mailboxes etc - there will be some small fee.

Even though you sent your items, they may not have touched them, if they haven't even opened it yet no one would have entered anything in to the system to acknowledge receipt.

(1) Federal Tax Returns.

Each sponsor must submit either a transcript or a copy of his or her most recent US. Federal individual income tax return (Form 1040, 1040A or 1040EZ), including all Schedules filed with the IRS. If the sponsor submits a copy of the tax return, he or she must also include copies of any and all IRS Forms W-2 and 1099 that reflect income used to qualify. The second note under paragraph 20.5(e)(2) provides guidance regarding what to do if a W-2 or 1099 is missing. Note, however, that it is not necessary to submit the Forms W-2 or 1099 if a transcript, rather than a copy, of the tax return is submitted. State or foreign income tax returns are not acceptable; if submitted, they must be returned to the intending immigrant.

There is huge backlog at Montreal, sorry.

Just because you 'sent it' and the mailroom at MTL has 'received it' -

is no indication of it winding its way INTO the hands of a ConOff. Those things take time. And since there's a backlog, will take MORE time. There's a queue, ya? I hope yer not hoping yer stuff will be yanked out of queue and given a higher priority??

Good Luck with the waiting. I know it sucks, but - it is what it is.

for DOS Hotline ppl to say 'it was received' - accccckkkkgrrrr..

A ConOff would have had to open the packet, enter something in the computer, for a DOS Hotline Person to have some status on it, to tell you. FWIW, there is NO STATUS of 'Received the evidence' for Montreal, that a DOS Hotline Person could see in the DOS computer. The MOST that a DOS HOTLINE person could tell you - is whether or not the 'received items' were used for further adjudication, and what the outcome of that further adjudication actually is.

IMO, you are seeking a status that is not 'statusable' - ie 'packet received at MTL'. Sorry.

No, Im not asking for any special priority. Everyone has to wait their turn. I was just hoping to find out if the consulate had received it and if all the paperwork was in order. I dont really mind it taking a while, if I know they have what they asked for and at some point receive my visa. Im just trying to be pro-active instead of re-active. This has taken so damned long already because we just sat by waiting to hear if things were right. We have contacted the IRS and are going to get a transcript. Do I just go ahead and send it it when I get it? Or do I have to wait for them to let me know if what they have is good enough?

PS, the congressmens immigration aid seems to think its good enough...ARG.

Here's my thought... Each agency you cross paths with in this process has different standards and guidelines, and each consulate around the world has varying standards and guidelines. DOS may not think the 1040's are good enough, and NVC may not think they are enough, but what Montreal thinks and wants may be different, and we all know they often like to interpret USCIS guidelines in a different way then we understand it (ie. Domicile) If there was a thread created that asked everyone what they brought as financial evidence to their immigration interviews, I think almost everyone would have a different answer. Some bring 3 previous years of tax transcripts, W-2's, pay stubs, the whole nine yards and their approval happens no quicker than some people who have brought a heck of a lot less. So, really, who knows. I have my fingers crossed for you!

Well and thats the thing, the NVC said all of our financial stuff was good to go before we went to our interview. We expressly asked them if all the financial stuff was right, and they said that it was. SOOO frustrating when the CO in MTL said he wanted my MIL's 2008's. And hers are sooo complicated, she makes money off property that she rents out and is self employed as a financial advisor, its all very frustrating. When I get the transcripts im just gonna send it off to montreal. If somehow theyve issued the visa by then, they can just throw them in the garbage.

This really sucks!!

OH JOY!!!! Panic mostly over... someone at the IRS faxed them to us :) For once someone helped us out efficiently. Now Im just waiting on my congressperson to find out the best way to send them. Since we did the OPTIN on electronic processing, I wonder if (because there is no official "seal" on it, nor are they originals) we could scan and email them to montreal?? Hmmm, in this modern day and age of the internet and what not, we shouldnt have to use donkey carts anymore.

Personally, I would just overnight them via courier - you can't afford any mixups at this point - well you can, but i'm sure you don't want any.

NVC is just a clearing house - I don't know what you sent to NVC for financial proof - but it's the CO that is calling the shots - NVC just makes sure that you have all the basic stuff and then some - or at least they should.

Since your interview was in March of this year, I assume you sent the original I-864s to NVC - but you musn't have included your MIL's 2008 return, now, that is absolutely something NVC should have caught - but they make mistakes.

Lol..my interview was back in february. Sigh. I will overnight them. Does this reset my "waiting for additional documents" time back to 8 weeks again?
