No, call deferred inspection - you can go to the one closest to you, it doesn't have to be where you came in, or even in an airport (though they are frequently near the airport). They are offices specifically for this sort of situation - to get paperwork worked out. It should be easy to see if it was stapled in at all - because there would be holes in the page!!

I do agree with what you were told that you should wait maybe a couple of weeks to be sure that your entry which was recorded electronically has filtered through the system and all of the databases updated.

It's called the "Deferred Inspections Unit" and yes you should contact them.

My wife's name was misspelled on her I-94 and we had to go there in person

to a back room at JFK to have a new one with her correctly spelled name on it.

The good news for us was that there was no charge, because it was THEIR

mistake and she did not lose the I-94.

The fee for a lost travel document is $320 and I don't see any way around it because it's your word against theirs and they are real bastards when it comes to that.

Just saying "is there anything else" at the airport won't likely help you, unless the immigration official you talk to at the DIU is having an unusually good day.

Ok, just to be clear:

- My POE was Philadelphia airport

- The Deferred inspection site is at Philadelphia airport

- I called the Philadelphia immigration office this morning and said I'd come, but they say it would be useless

- There is no other immigration or deferred inspection site around than the one that is at Philadelphia airport which is also the one that's the closest to me.

And of course, there is no holes in my passport... Plus I actually checked when they gave it back to me there wasn't anything.

There is just my visa which is stamped with the entry and expiration date of the K1 visa. I actually believe that this stamp should be on the i-94 form not on my passport...

I'm afraid there's not much to do than wait two weeks, I understand that they can't issue one if they're not sure if it has been ever issued...

What I'm scared of is that they actually processed my I-94, because I gave it to them, but they didn't staple it on my passport and say I am the one responsible for having lost it. Which would make us filling for that 300$ fee form... -_-

Yes.

With all the bailout money being paid out they are looking for easy cash from unwitting citizens.

I did fill the I-94 form for sure and I did hand it to the POE agent when I handed the brown enveloppe too.

The day I landed the airport was VERY crowded, I had to wait 2 hours in the immigration lines then another hour at the Secondary Inspection office which was also full of people.

I am 100% sure that no I-94 form was handed back to me, because I checked my passport when they gave it back to me, and I told them "Isn't something missing, a stamp this is it?" God knows why I didn't insist on the I-94 form, I was truly exhausted.

The office I called is my POE, which is also the Deferred Inspection site, which is also the nearest immigration point. All those seem to be the same office which is located in the Philadelphia Airport.

Other than that there's Dover's USCIS office but that's a 2 hours drive away.

It seems to be normal they have no record for now, they told me it usually takes 2 weeks to get processed and appear on their system.

I guess I'm going to wait a week and called the Deferred Inspection number, hopefully by then I'll appear somewhere in their trackings.

Wait a week and ask again. They should have the records by then, as I found out (too late) when we applied for her

social security number too soon after her POE. Now we have to wait for the AOS to apply for the SSN.

The fact that you have a valid stamp & NO staple mark should work in your favor, even if they may try to con you into paying the $320 fee.

They shouldn't claim that you didn't give them the I-94 fill-out form from the plane because they stamped you into the country and the

I-94 is part of that process that THEY forgot. Know your rights before you go in there. They are a humorless bunch.

If you DID have a staple mark on the page they could claim that YOU lost it.

You talked to the wrong guys; get confirmation of which terminal the DIU is in and go there (you may need an appointment and they CAN be

reached by telephone). We went without an appointment and they asked me in the door (a la wizard of OZ) if I had one and I said YES.

I lied. They let us in anyway and it was successful.

Blah...

So I called the Deferred Inspection site.

But they gave me another number, and that is the number of the nasty rude woman :(

They told me flat out that they consider my I-94 as lost, doesn't matter who has lost it, and that I'll probably have to file for I-102.

Basically I'm back to where I was before, which means wait a week or two...

When you say you are ringing "deferred inspection", are you calling the deferred inspection section of a local USCIS office, or are you calling CBP at your local airport?

I couldn't find any other around.

There is no Deferred Inspection site listed for Delaware.

Even for Pennsylvania, the only one that's listed is the one at Philadelphia's airport.

We had the same problem with them not stapeling the I 94 in the passport.

We found out that we needed it when we went to get a ssn. They wanted the I94,

like, where is it and what is it.The lady said that they ALWAYS stapel it to the passport.

I think "NOT". Went home and found it after 2 days of looking.

Luckaly we found it before it got trashed with some old papers.

There is enough problems and head aches with out something like this!

No there aren't.

You don't have to go to a site designated as "deferred inspection". You CAN politely get yourself back to the actual area wherein you arrived. It's been reported on Vj before. The trick is getting through to the Commanding Officer. I can assure he will want to correct the problem.

Now that I have calmed down a little, I think it's legitimate for the CBP to see if it's been lost or never issued.

Without that information I can't even file for that replacement form...

No you really don't want to wait. The sooner you get on it the better. That shows accountability on your part. It indicates you are telling the truth rather than "making up a story" to cover up losing the document.

Whomever it is you are getting on the phone (the mean lady) is acting outside the scope of her authority. It is FAR from unheard of for an alien to NOT be issued an I94. There has actually been a LOT more reports of this happening on Vj recently than I have ever read in the past.

Thank you very much for your help, but in Phily's airport, these are just the same site...

My main problem right now is that we don't know if the I-94 has been issued or lost, and it obviously requires a different treatment.

It seriously makes sense. And that can only been known in a few days now.

I have a name of an officer, she promised she would take care of it (even though I thought she was rude, I wasn't exactly polite myself...)

I have a phone number with an extension to call back, I highly doubt it would make a difference if I harass her...

I've read most stories here and they all realized they didn't get their I-94 after a while.

Getting it corrected is very different... since they can provide the I-94 number.

My case seems to be totally MIA for now :s

But it's not sure it hasn't been issued...
