Employement Authorization Processing..slow?

Hi everyone,

My husband and I have filed his employment authorization and request for permanent residency, but it has been months-since January. I know the aproximate wait time is about 3 months but as you guys can see its been longer.. We got a RFE for the employment authorization, which we sent in. It seems like this whole process is taking a long time- from what I've seen in the time lines, it's taking other people much less time. Is anyone experiencing the same wait time currently? The USCIS 800 number is not much help either because they cannot tell us anything detailed other than "3 months, sorry". Any thoughts as to whether they may be backed up, or if this kind of wait is normal? We're getting kind of worried about how long it is going to take for him to have work..

Had you not received an RFE for the I-765 it would have been approved on that date.... Because of the RFE you took your self out of "normal" processing... When did you respond to the RFE?

If it takes more than 90 days for the EAD approval, you can get an INFOPASS to request an interim one. However, since you have RFE for the EAD, that sort of complicates the time frame, since they start counting the 90 days once they receive a properly filed application.

If you are past 90 days - I would make an INFOPASS and see what they will do for you. (the only question is if they started the clock on the initial NOA or on the receipt of the RFE)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

March 25 they received our response. We are still waiting to hear any news. Also for the I-485 which we filed at the same time- on our case status it's some how still pending on "initial review" which seems absurd after all this time. Anyway, all we can do is wait. . .

With no RFEs, hers and his took two days less than 2 months to go to card processing status.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

I'd guess 2-3 weeks minimum after receipt of RFE info...
