Let's get to the bottom line, shall we?

You filed for AOS, received the NOA. At that very moment, your status changed from lawful non-immigrant visitor to lawful non-immigrant visitor pending AOS to Lawful Permanent Resident (LPR).

Not only can't you leave without jeopardizing your application, nor should you. You are as legal as the President of the United States here and will be until your AOS petition is decided upon.

If the decision is positive, which is the default, you have become an LPR. If it's negative, you have 30 days to get your stuff packed and to leave the US of A.

Thanks for getting to the point Bob! But I haven't filed for AOS yet, my husband has only sent the I-130 petition away (5 weeks ago and we have only receieved a receipt saying that they have only received the petition). We will be sending the AOS application off on Monday after I have had my medical exam. I now know that I can overstay my 90 days as long as I send off the AOS application soon (my 90 days are upon the 26th April). My fingers are crossed that this is ok.

You are good. just remember to add the I-130 receipt to AOS package. Good luck.

On a side note - I was wondering how long it usually takes for the I-130 petition to be approved? We are now into the 5th week and to date we have only had the NOA receieved receipt.
