hey,

Me and my Fiance live in Belgium and are going to get married in a couple weeks. Whe are only 22 and 23 and i whas planning on turning my papers in the embassy the week after we got married.

Is the embassy making problems for that or our age?

My fiance is playing basketball over here but he always gets paid under the table + he's doing is degree online, can we say to the embassy that he didnt need to file taxes because he is a student?

He is going to work at home as an assistant coach so thats why whe want to move away.

Whe are going to live with his parents until whe have our own place and I got a job, Or do you need a place by yourself?

Your ages wont be a problem. You are over 18, so fine.

He CAN say that he was a student and doesn't need to file taxes, but of course you have to be careful with that, as this is technically tax fraud I guess. And I'm not sure if it's as simple as that. Whether you can just write a letter explaining that or if you have to file claiming nothing, I don't know. Hopefully someone else can answer that for you. But be aware that your husband HAS to prove US domicile and filing US taxes is a good way to do that, so plan on having other information to prove that if he isn't going to file taxes.

You do not need to live by yourselves. A letter from his parents saying that you two will be living with them is fine.

The IRS doesn't give a rat's ####### if you were being paid under the table overseas, nor is it going to tell the Belgian tax authorities that your fiance was working off the books. The IRS DOES want to know what your fiance was earning even if it was not being taxed by the Belgian authorities. He should complete 1040s for the appropriate years that he made over the minimum for filing and declare this income. Being a student, unless one's income is below the minimum for filing, is not an excuse. Hell, when I was in college I filed every year for the pittance that I made in my work-study job.

The only excuse for not filing is if one's income is below the minimum requirement. For 2009, the minimum for someone filing as a single person (which your fiance was last year) was $9,350. And as Marina said, filing your taxes is not only a requirement but can be part of proving US domicile.
