Hello,

Just read a post from another topic by Nik+Heather. Said that last year at this same time processing of family based visas stopped for a few weeks when the USCIS started to accept H-1B visa applications. This year the USCIS states that "We will begin accepting H-1B petitions on April 1, 2010 that are subject to the FY 2011 cap." Does anyone know if it is true that starting today we will likely see slower processing times? That's disappointing since I've seen some lightning fast NOA2 come out and was hoping to have the same :(

Hello,

an annual occurence... slows down processing for a few weeks or so ... the length of time will be determined by the number of H1-B's received... in 2008 and before the limit was reached after just a few days... last year it was not...

We filed on monday and our petition was delivered today ....and just read this H-1B story like you. I just hope it does not mess up our time plans.

So good luck to both of us.

First, do not make any time plans. Second, do not expect lighting fast processing.

The service centers routinely "shift" priorities onto different visas. It happens all the time. It is not a one time a year thing for one particular visa. Read the pinned topic on the top of this forum for some detailed inside the Service Center info on just this topic. During these "shifts" some adjudicators are kept working on other visa types. work on I-129f's will not "stop" but there may be less adjudicators assigned to them.

From late September until early November 2009 there was a "shift" to I-129f's at the VSC (discussed in the pinned topic) and no one complained with petitions being processed in less than 30 days. Except the I-751s which seemed to take a back seat about the same time.

You have entered into a process which takes many months, assume it will take many months, relax and start your plans for the future, there is a lot to do and a few months is not a lot of time to do it in.

i agree with the statement above..always assume that the processing will take months.. its always nice to have a little surprises..everything will always come at the right time and at the right place!

We had to contend with the shift from I-130's to I-129f's ... like someone else mentioned. Settle in for a 5 month wait and maybe you'll be pleasantly surprised.

hope everyone is wrong about this delayin K1's, but everyones has been right b4, and its true about this months of journey we should be gettin ready, actually my 2 months waitin for n02 hasent been so long, got alot of plannin going on and gettin ready to settle down and gettin ready to adjust to the life of no single any more(thats d hard part) so i am taking this time very seriously, i know my baby worth all d troubles everyone here has and them over, its really harder for them, Good Luck every one, i am so jeoulous of Newbie jaja, i should be right behind you with mmy N02 hope fully soon, good luck everyone

Hello just curious, how about during August 2009 filers, did they shift to other visa also?coz until now we haven't received our Noa2(7 months already) we feel we are the last batch left, so frustrating. any idea? do you believe all will be approved just in time? tnx.

7 months is over the processing times. Since you are over the published processing times, you can call and make a service request on your case. They may come back and say "security checks" or something with no time limit, but at least you'd know they hadn't lost your case.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.
