They gave it to you because you applied for it. However, apparantly, it does not trump an overstay. The overstay trumps the AP, but it only comes into play when you try to reenter.

I think if the EA card has a picture on it, that should be enough to show the airline workers. If you are flying domestically, you usually don't have to show your ID to anyone but the airline. Regardless, no one will be looking to check your residency status. They will only be concerned about your picture ID matching the name on your ticket. But bring everything with you just in case, including your 797s.

Yes it does have a picture ideed. The thing is my name is different between passport (maiden name) and AEcard (married name)

I always carry with me a copy of our marriage certificate, just in case, so I'll be prepared to take the plane!whistling.gif

Oh boy! Guys , if you overstayed a little bit or about to gain overstay don't travel outside US including PR and Hawaii. Within US it's fine.

Do you think they'll still send you a EAD card if your interview comes first? :blink:

And how does it work again? EAD is good for a year. And would they send you a renewal card before the one year expires?

Looks like my IO was right on the money - they ordered my EAD yesterday even though my GC was approved Monday. Oh, USCIS...

That's great! I would say your letter is on it's way!!!!! Hopefully today or tomorrow.

On the site when I log in to see my status it still talk about my review as of MAY 5th.. WTH.. No wonder no email's and txts.. I am livin' in the dark... Guess I will know about the EAD when it arrives... SIGH.

ohh and yes I am an overstay and I asked around at some agencies and did not apply for advance pAarole cuz technically they should let you in but as alot of you mentioned if your an overstay they can issue the ban and not let you return for years.

I am 5 year overstay so i would get a 10 yr if i left, thats crazy.

I am actually a little scared of the interview because I do not have a entry stamp in my passport becuase that passport was lost and i got a new one. So my new one there is ZERO stamps in there cuz i havent traveled anywhere since. But I do have my i94 card so i hope that will be enough to prove i entered legally and with inspection.

yea the EAD doesnt really count for anything once you leave the country, i believe on the card itself it states that it is only work employment in the US and does not guarantee for you to re enter the country.

I mean techinally if you have Advanced Parole they should let you in, but as i mentioned beefore I wouldnt leave the country

until I had my greencard in hand.

Im actually afraid to drive to another state because once you go up north near canada they randomly check cars and buses for illegal immigrants. OMG if i lived in Arizona i would probably be afraid to leave my house because of that new law...

I think you letter is coming, you were one week behind me. That wait for the final letter... SUCKS. my husband is also an overstay 4.5 years. I get so nervous when he is out. I have a friend Laurin, her and her hubby just finished INS he was here 7 years. The IO said... Well if you were marrying for a GC guess you would have married alot sooner...

hello every one here!

I'm coming from a very nice SSA/DMV trip, and i made my case move forward.

1- at the SSA: I got a provisory SSN card, w/ THE SSN on it! (30minutes)

2- at the DMV: went directly to DMV and file for DL, succeed my writing test first shot and *surprise* I'm allowed to drive already! (because i had a licence from France)

I still need to make an appointement for the driving test, but at least I'll be able to go around by car starting NOW! kicking.gif

At DMV, the lady that registered my DL application told me that EA Card is PROOF of LAWFUL PRESENCE (she didn't even asked for my passport)! Also, I never overstayed before. I went out of status 03/02 and my EA card is valid since 06/09 (I have 3 month overstay, that is nothing IMO)

It's written on the card NOT VALID TO REENTRY TO U.S. but I'm NOT leaving the country going because HAWAII IS PART OF THE USA!! so there is NO REASON for me not to go! (+ I really could use the "cocktail by the pool" stress remedy anyways wink.gif)

There is a difference between leaving the country, and traveling in the country. As traveling outside the country may be risky and jeopardize AOS, traveling inside the country should be OK! I 'm sure I read somewhere that having an AOS pending protects the beneficiary from beeing deported from USA. Now they allow me to work here, that is proof i can stay in the US.

I guess I have no choice now than to try that theory out ;).... If you don't hear from me after 07/01 then I'll probably be in jail... laughing.gif
