!!!Someone Please Help!!!

I got the RFE today finally. it says:

What the f### is going on? The idiot I spoke with at USCIS was a broken record who could not explain anything to me. She just kept reading the same old stuff. I almost told her to shut up (but told her to stop multiple times during her recordings).

Why are they not considering my wife's income and work? Why are they not factoring it? I asked the broken record b#### (BRB from now on), but she just spouted the same thing on the form, and that anyone who would know has no contact information (#######?!).

The assets we included were just icing on the cake, but her work alone meets the requirements without any assets.

Someone mentioned they were expecting an RFE anyway because of no tax forms. Is this what it says on your RFE? Any chance you can ask your lawyer on my behalf? I'm desperate and in shock.

This whole process is going wrong every step of the way and this is the worst thing imaginable.

Ok what visa is she currently on? and is she legally allowed to work in the US? does she have work autorization?

I dont think it is because of the taxes because they would not state that the income isnt enough but instead ask to missing documents to document your case. It is true the intending immigrants income only if he can prove it will continue from the same source but most importantly that the immigrant is working completly legally in the US. For example I worked for few years had a temporary tax ID so i filled taxes and earned more then the minimim in the guidline but since i came in on a tourist visa I was never allowed to work so they r not counting this money I made even though i payed taxed. I couldnt work and thats what they look at. From what I spoke with at an agency which files such papers and helps people the intending immigrants work and money they make rarely gets factored in. Thats why in my case I needed a co-sponsor even though techinally i earned above the minimum and had taxes it still didnt count.

So what visa did your wife come in on?> and does she have a SS and legal work autorization to work and how did you try to prove that the income will continue from the same place.

On anothed note, I really appreciate the Manhtaan office info!! I went the second time! and I went today and I did my WALKIN IN BIOMETRICS!!!

On a 2nd try but they people in the manhataan office were much nicer, the security downstairs said I might have a problem becuase on my paper my appnt was scheduled somewhere else and they dont like doing that. But once the guy gave me the application, i filled it out he even helped me later and checked it over to see if I filled everything out correctly. And they took my prints and photo. THey had some trouble taking my prints, i have a cut almost healed but had it on my finger so i hope it all works and they wont call me again!!! Fingers crossed!!!

hmm well i am not sure what visa you are on, is it fiance or tourist?

because i came on on a tourist and those process might be different because with finace visa you already applied wit USCIS and this is 1st time i sent anything to them.

Well i see we have very similar timelines, papers were both delivered on april 26th and yea its strange because they were both touched the same days may 5th and then two forms were touched may 17th.

Well i got my biometrics appnt on the 11th and it was dated may 5th so i thought that touch was because they sent out my biometrics. But some touched I know wit people the forms just get touched and ppl dont get any documents.

I think you should be getting your biometrics apppnt very soon. What state are you in? Im sure scheduling depends on how busy the state is, for example I got my biometrics scheduled in 3 weeks in NY but ppl got it wit a similar timeline scheduled in 2 weeks. Depends probably on how many applicants they have in a state, unfortunatly I think NY espceially NYC is a very busy immigration state.

And i agree I see that the USCIS site might not be 100 percent accurate, it stated on the site that this is a new pilot program so I guess they are just starting this and working out all the problems.

yea it was written in the instructions that you have to send proof of the joint sponsor being a citizen. I sent in the persons biometrics pages of US passport and I sent in the certificate of citizenship just to be sure lol.

Hmm well i was wondering about that, if you send in a application before april 15 they shouldnt want 2009's but i guess they do. Also i was sure to also sign the copies of the tax return because the copies that stay wit you usually arent signed so i made sure they were all signed just to avoid any problems.

No, I'm adjusting from a tourist visa so it's the same situation.

I live in Orange county, California, and I have no idea if the state is busy or not. The only thing i know is that they forgot me in the process

I had to wait so long compared to others in my timeline. Sorry they rejected u :angry:

Cant answer about the military but i do believe u have to be a resident (citizen)

I'm pretty sure you don't even have to be a resident. I know it is a door to residency/citizenship for some. The local recruitment office will be able to tell you. If you don't have one in your area, check out the local high schools to see if they have JrROTC programs. The ROTC director could probably tell you as well, or at least put you in touch with someone who could.

I've been constantly trying to contact an attorney or lawyer who can help me with this nonsensical RFE. So far I've gotten many "we'll call you back to schedule an appointment" with no callback (#######), along with an email basically saying, "Sounds like you can figure this out yourself. You can solve your problem by reading the instructions instead of bothering me."

The babbling a$$es at USCIS just keep reciting the same BS. =(

I reviewed and did everything right: we showed proof of continuing pay (of course it's legal) and everything. =(

Jinxxabelle, could you write what it said on your RFE? I'm just curious.

I think Wednesday before noon and afternoon are the best times... Vanessa & I both did ours around 10:30 & 11:00 and were successful... So as long as you go on a Wed is good; actually I overheard the guys bragging about only having one or two appts per hour as compared to other days (if that helps) :thumbs:
