I got the RFE today finally. it says:

Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor and household member(s), the net value of the assets does not make up the difference between the sponsor's income and the poverty guidelines.

blah blah blah

What the f### is going on? The idiot I spoke with at USCIS was a broken record who could not explain anything to me. She just kept reading the same old stuff. I almost told her to shut up (but told her to stop multiple times during her recordings).

Why are they not considering my wife's income and work? Why are they not factoring it? I asked the broken record b#### (BRB from now on), but she just spouted the same thing on the form, and that anyone who would know has no contact information (#######?!).

The assets we included were just icing on the cake, but her work alone meets the requirements without any assets.

Someone mentioned they were expecting an RFE anyway because of no tax forms. Is this what it says on your RFE? Any chance you can ask your lawyer on my behalf? I'm desperate and in shock.

This whole process is going wrong every step of the way and this is the worst thing imaginable.

i know how u feel

i got an rfe on accident because they claimed that my husband isnt meeting the requirements

u only need 14000 a year for two people

plus he is military

thats bullshit, those customer service people dont know ###### bout immigration i dnt even think they know who they work for ...they just read n read / n everythin they read u cn read

the officer said that they tend to make mistakes lyk dat a lot

theyy send u back papers w/o reading further into

they didnt even bother reading that my husband is army they just sent one

they are ###### ####### they have our life in their hands in a way and they r fuking around with our papers...

i suggest u get an infopass appt n go talk to them

and request for the customer service number to let u speak to a higher auhority , lyk and officer or something

Sorry to hear that!

Come down and schedule an infopass for sure, as Sensii said.

Try to find all info you need on USCIS web site and print it out. So you can put their nose into it and let them resume your case. Also bring copies of supporting documents you mailed initially. On this info appointment you will be able to prove yourself. Gather as much as you can!

So sorry for the disappointment.

Am I right that your wife is the beneficiary/applicant? I ask because I know it's different when you are using the intending immigrant's salary. I don't know the ins and outs of it, but someone else on here who has experience with that might be able to help you better if that's the case.

Thanks all, I'm still shocked and confused. I just read I-864's instructions (for the umpteenth time) and the I-864A. We only need to fill one out because she is my wife (the intending immigrant), so I don't know what the issue is. I still don't know what I did wrong or what I missed. I went to the infopass site and it asks for what reason I'm scheduling an appointment. Unfortunately, June 1st is the only date selectable. There has to be a faster way...

It says to call them for clarification, but the BRB was just a moron and completely unhelpful.

And yes, my wife is the intending immigrant.

This forum has limited traffic. You might get more information if you post your question with all the details on another forum. There are bound to be people with experience with this who might be able to tell you what to expect.

Hopefully it is like you were thinking, that your 2009 taxes weren't filed yet, or whatever. I know it's the waiting that is so frustrating. When you know what you need to fix, you can fix it. It's the not knowing that makes it difficult.

I'm sure whatever it is, it will be easy to fix. Chances are it is their mistake. I've read where they just don't read all the papers and send out an RFE. You just have to send the papers back so that they know what they are looking for this time.

Finally had a huge relief today =) I faxed in an expedite request for the I-765 EAD card yesterday after talking to the Congressman's Office last week and I received the approval e-mail this morning. My I-765 is in "Card Production Ordered" and it will take about 2 - 3 weeks to arrive! Phew!!!

April 19 - Mailed in AOS package to Chicago Lockbox

April 27 - Check cashed

Here is what I found on the subject;

Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident.

Question: Will her income continue from the same source after she receives her G/C? Did you include a letter of employment with your package? I would definitely get a letter ready for your infopass :thumbs:.

I got the information from page 2 of the i-864 document. Show them this and make them eat the RFE (lol).

hmmm I logged on today and I see that the I130 and I765 was touched on the 17th. The I485 was not touched though since the 05/05. I wonder what they were doing with those two forms, if they needed any extra documents or info it would be in RFE right? Because right now it still says Initial Review.

Well i see that some of you had only two forms touched out of the three like Alla. But you had 1485 and i765 touched first.

hmmmmmmmmm I would love to know if they actually did something or just opened and closed it just to make me crazy :wacko::help:

Are you trying to do an expedite request for the I-131 Advance Parole? Google up your local Congressman's Office and call the person who handles immigration. He/She will send you the release form for them to send in the expedite request for you. When you send back the release form, try to include supporting documents to back up your request.

Oh and also, if you are expediting I-765 EAD, I would suggest giving it at least 2 weeks after completing Biometrics before submitting the expedite request. As for I-131, biometrics are not needed so you should be good to go ahead. You could try calling the customer service line to submit an expedite request but I did not have any luck with it and they rejected it because I didn't have any evidence (although I asked the rep if I needed to send in supporting documents but he said no!!)
