Weird my I-130 and I-765 were touched today even though I didnt have my biometrics done. Any ideas?

Same here, I got touches since yesterday. I haven't receive my NOA 1 yet or my biometric letter. Although the MSC numbers are already working.. :unsure: :unsure:

1. I'm pretty sure you do not!!! If you look through the instructions for the I485, it says you can file if you have an approved petition, are filing concurrently with an I-130, or if you have proof of a pending I-130. You'll have to send in the I-767. You'll want to call the help line to be sure, but I'm almost positive you don't have to start over.

2. I'm pretty sure you can. You'll be sending your marriage certificate, so it should be okay.

3. If you are not starting over, then I think you have to include that number.

4. Again, I'm quite sure it would be Houston. Did you have to show your passport in Houston? Also, did you get an I-94? I ask because I know sometimes Canadians don't get them.

As for the question about whether you have applied before, again, if your I-130 is still pending, then you haven't applied yet. Your husband has filed a petition for you, but you have not applied yet. You can't apply until the petition is approved, or unless you file for an AOS.

Like I said, you'll want to check with the helpline or some other source, but I'm pretty sure I'm right about the above.

Thanks GabiandVi! I will phone them tomorrow, before I talk to my lawyer. Re: the POE - I showed my passport to the US border guards in Toronto, and did not have to show my passport in Houston. They did give me an I-94, because I was married to a US citizen and (I assume) because I had my cat with me they sent me to secondary, but still let me through.

My attorney sent my AOS packet today, so how do I know if I'm an April filer or a May filer? Doe sit depend on when they receive my packet or when we get the receipt?

I recieved my textv NOA's on all packets and the MSC number but can't check it online yet. How long did it take you all to see anything online? What does it mean since we recieved the text? That they just opened the packet or have they actually reviewed anything yet? Thanks guys!

The text is letting you know that you will be sent a receipt notification. It doesnt mean they began reviewing it, I think its more along the lines that they cashed your checks. Until you receive the actual NOA hardcopy, it'll be unlikely that you can view your case status.

Besangel is right. I would only add that it does mean that they have at least looked through your petition and application to be sure there is nothing to reject it outright, i.e. lack of signatures, wrong fees, etc.

She doesn't have an approved I-130 yet and she needs to file a new one. Regarding the previous application , she explained that she won't be able to respond on time for RFE and application will be automatically denied in 6 months. You can't put it on hold or transfer to a new one.

According to my lawyer, I (well, my husband) do not need to file another I-130, so it will save me that money, at least! As long as she is correct.

Hello! I hope I'm in the right thread. This is a AOS from my F-1 status. I submitted the AOS package based on I-130 petition (February 2006 PD) on April 19 and it was received on April 21. Check was cashed on April 27. Unfortunately, I did not submit the Form G-1145 along with the AOS package so too bad I can't get my receipt numbers until I receive the receipts =( Here is my time line:

April 19 - Mailed in AOS package to Chicago Lockbox

April 21 - AOS package received

April 27 - Check cashed

Just be sure to include proof that you filed an I-130 when you sent the I-485

My wife got her biometrics appointment yesterday! It was scheduled for end of may, but she immediately took care of it today in the downtown NYC office. They said they only allow walk-ins on Wednesday, but they were very nice and let us through. She got it done and now I guess it's a waiting game.
