Hi, everyone. I won't be an April filer, but I should be an early May filer if I can get the following questions answered. I did set this up as a separate thread, but no one replied. crying.gif Can anyone in here help me?

A bit of background - I have been, up until this point in time, doing the CR-1 process. However, due to an oversight by my lawyer (I did not know about this site when I filed) I did not get a copy of my criminal record from the RCMP before coming to visit my husband in Houston. Of course, this caused an RFE at NVC. To get one takes around 6 months, and Montreal is so backlogged, that there would be another 3 months tacked onto that before an interview. So, another 9 months total of not being with my husband. Since I am with him now, we are talking about just switching to AOS - I definitely did not have any plans to immigrate when I came into the US, and have paid money into the CR-1 process since arriving, as proof.

I am filling out the forms (not using the lawyer for this, as she screwed up too badly already, and now I know about this site and don't need her!) and have some questions:

1. Do I need to fill out another I-130 and pay the fee?

2. Can I fill out all the forms in my married name, even though my passport is in my maiden name?

3. Do I use the A# from the CR-1 process, or leave it blank?

4. I flew from Pearson Airport in Toronto, and went through US border inspection there. Is my point of entry there, because that is where the inspection was, or Houston, TX, where the plane landed?

Thanks for any help you can give me.

1. Yes and also you need to withdraw any previous applications/petitions. You have to pay a new fee.

2. Yes

3. Yes, A# is one and only. You should use it on new application.

4. Point of entry is where the plane landed. Pearson Airport in Toronto was a security point that checks your visa and belongings.

This may be a stupid question, but on the I-485: Have you ever applied for permanent resident status in the U.S.? would be Yes, correct? Since I was doing a CR-1? And I just put down the date I cancelled the petition?

I've just got my biometrics appointment letter, it is for 5/21 which is too long to wait that much I think I will go next week to do it as it will need a full day, 2 hours driving to Milwaukee And another 2 hours back :S

And no, no it isn't. Sigh. Now I am trying to figure out how to answer, on the I-130, #16 - Has your relative ever been under immigration proceedings? What does that mean? Is it just if they tell you to get out of the country? I need sleep.

Maybe because it was scheduled. Who knows why they do anything. I am waiting for my delivery confirmation. I am sure it will be there tomorrow... God willing.

A proceeding is going to court for one reason or another. If you never stood in front of a judge in regards to immigration, the answer is no.

OMG GUYS!I can't beleive what I did. GRRRRRRRRRRRR.. I was looking over my copies and I sent in I-485 with an expire date of 11/30/2011, but it is not the most recent form. I printed the wrong one from my files. It clearly states that no other form but the most recent will be accepted, guess my package well be coming back. Already have the new paper ready. I can't believe I did that I am soooooooooooooo annoyed!

1. I'm pretty sure you do not!!! If you look through the instructions for the I485, it says you can file if you have an approved petition, are filing concurrently with an I-130, or if you have proof of a pending I-130. You'll have to send in the I-767. You'll want to call the help line to be sure, but I'm almost positive you don't have to start over.

2. I'm pretty sure you can. You'll be sending your marriage certificate, so it should be okay.

3. If you are not starting over, then I think you have to include that number.

4. Again, I'm quite sure it would be Houston. Did you have to show your passport in Houston? Also, did you get an I-94? I ask because I know sometimes Canadians don't get them.

As for the question about whether you have applied before, again, if your I-130 is still pending, then you haven't applied yet. Your husband has filed a petition for you, but you have not applied yet. You can't apply until the petition is approved, or unless you file for an AOS.

Like I said, you'll want to check with the helpline or some other source, but I'm pretty sure I'm right about the above.
