please am bit confuse now i have sent out my doucments two weeks ago to american ebmassy .... and waiiting for my interview date, am going for k3 .. is it going to affect me since k3 is no longer availble ...... my wife file for k3 visa since May 2009, then Nov 9 2009 they sent my doucment to turkey's embassy in anakra ... please am bit confuse now, i don't know what to do .....please help me

It would appear your I-129F cleared NVC prior to February 1, 2010. If so, your K3 process will proceed normally.

Facts are cheap...knowing how to use them is precious...

If Turkey is asking you to continue, asking you to handle the documents, then by all means RUN with it, and get the visa.

It's my understanding that you have up to 1 year to complete the Embassy paperwork for the visa application in Turkey. 6 months have passed already - so if you want to keep going with the K-3, you've got some work to do on Monday.

OTOH, yer wife can also kick start the I-130 at NVC (it's up to her to do that, btw) .

If that K-3 is valid at Turkey, today, then go go go, finish up, make it happen, and GOOD LUCK !

well, you could ask yer wife what's up, which visa it is -

or you could check if she needs to give you an I-134 (for K-3) or an I-864 (for IR-1)

Seriously - check in with yer wife, inquire.

if you meant 'my K-3 is still in process' then ya, I agree with that.

So, how do you tell USCIS if you want to apply for which visa? Also, I thought that K3 is obselete right now, right? If so, then people can't file K3 anyways, right? Also, does one need to file I-129 still?

02-24-2010 - I-130 Sent: February 24th, 2010

06-17-2010 - NOA2

Your I-130 was APPROVED in 107 days from your NOA1 date.

06-24-2010 - NVC Case Number Assigned

08-24-2010 - Sign in Fail - Case COMPLETE in 60 days

10-27-2010 - INTERVIEW Riyadh

11-27-2010 - VISA issued

01-06-2011 - POE JFK

01-27-2011 - Welcome letter

01-28-2011 - Green came via Priority mail

01-06-2011 - GC Issue Date

02-05-2011 - GC Received

02-10-2011 - Applied for SSN at local office

02-19-2011 - SSN Received by mail

10-06-2012 (?) - GC Extend Date

01-06-2013 - GC Expires Date

Here in the phils are they going to honor the K3 still? What are the documents needed during the interview? Did not have this DS-230 filed do i really need one now that i have an appointment this coming 21st of may, need help. Really confused.

If the I-129F was approved , and it was sent on from NVC into MNL, then you'll need to prep a full packet for the visa application. USED TO BE, MNL would send you all forms in a P3 packet - but that's not the case anymore - you have to download them now from the USEM-Manila web site.

I'm hoping, by now, you've accumulated all yer forms and you have appointment (or finished) for the medical exam.

Your USC Spouse can figure out what you are interviewing for - ask him to check in with NVC, get the MNL case # from an operator (give the USCIS casefile # ), then ask if K-3 or CR-1/IR-1 visa interview. You should also have the 'visa type' listed in the appointment letter.

Is a 'timing' thing.

IF the USC petitioner filed both the I-130 and I-129F, and IF the I-129F was in and out of NVC prior to 1 FEB 2010, then usually the I-129F will be sent on to the Embassy.

If approval was after 1 FEB 2010, then yer out of luck IF the I-129F and I-130 travel together to NVC, as NVC will 'administratively close' the I-129F once it shows up at NVC.

as to 'telling USCIS' - it's not so clear, right ? If file I-130 solely, then it's CLEAR one is hoping for CR-1/IR-1 visa, down the road. If file both the I-129F and the I-130, then is some 'hope' for a K-3 visa - but, IMO, after 1 FEB 2010, that hope is dashed. Splatted into the rocks, turned to ash, floating in the wind, never to be recovered.

as to 'needing to file I-129f' - That 'need' diminished as USCIS decreased the amount of time needed to process the I-130 petition, and diminished further as NVC 'got better' for their processing times, as well.

IMO, that 'need' is non-existent, after 1 FEB 2010.
