Hello,

My wife is a US Citizen and we filed the form I130 to get me the required papers to be with her back in Sept. 28th, 2009.

We filed the form correctly but all communications we have received from USCIS let me believe that they have wrong information. For instance, they told my wife (USCIS) that the number of visas was not available for our request type and country of chargeability.

Then we asked for information on why it was taking so long (it has been 6 months when national average is 5 months). The answer was that they are still reviewing the case and it is under the normal processing times as they are reviewing cases from Feb, 2007.

What can I do to ask them to check back my form? I think they registered something wrong in their systems.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I'm thinking the same as Scott, did your wife recently become a citizen? If so, did she request to update your petition?

To me it sounds like your process is like the one for LPR's petitioning a spouse.

Since this is not the case, you really need to get ontop of things and make sure they get notified that your spouse is indeed a USC and you are not required to wait for a visanumber to become available.

You did get in touch with your congressman/woman right?

Make sure they know about your suspicion that your case may be treated like a "LPR-case". Hopefully they will be able to help you!

I hope you will get a news from the uscis

as you see i m still waiting too u can check my timeline too it has been almost 5 months and i did not get any information yet as well

Actually no, my wife has been American Citizen since she was 5. (She is 26 now.)

Her parents became citizens long ago, when she was 5, and therefore she got the citizenship in that process. In the form I130 we stated that she is a US citizen and got the citizenship because of her parents. Also, we included copies of the US passport she currently holds.

We have asked the congressman for help and will be calling tomorrow to USCIS to ask them to check with them.

Then this is weird,cause it sounds like they have your petition under LPR-status. Hopefully you can get this corrected by calling them and making sure they know she is a citizen!
