Hi All,

I need your input/opinions on this matter. I realize you are not attorneys, but I'm interested in what you have to say. Here it is.

I have applied for citizenship and currently awaiting biometrics. When I filled out my N-400, I completely forgot about about an incident that occurred in 2002. A fight my friends started, that I was blamed for as I was the driver. Nothing came of it as the officer noted what happened and said they'll be in touch.

2 years later in 2004 I received a letter from the local court stating that an arrest warrant was issued. I hired an attorney and had the arrest warrant recalled and all charges dismissed. I was never arrested or even finger printed for that matter.

The omission on the N-400 was an unintentional mistake, as I honestly forgot about this silly incident. Last week, I contacted USCIS via 800 number in an effort to amend the N-400. I spoke 2 agents and took down both of their ID's. Both stated that I can change my N-400 at the time of the interview. I am going to disclose this at the interview, as I have nothing to hide.

My questions to you:

If I write a letter stating that I attempted to amend the N-400 due to an unintentional error and provide agent ID's with whom I spoke with and dates, do you think the interviewing office will give me hard time for not disclosing it?

Do you think the assault charge that was dismissed will have an impact on my naturalization, even if it was cleared and I have a certificate of disposition to show it was dismissed?

You don't need a letter, just make the changes during the interview. Since, the charges were dismissed you shouldn't worry about it but be prepared to furnish a copy of the disposition and perhaps, to be sure, write a brief statement regarding the incident. Your attempt to disclose this will be a plus because you will be viewed as forthcoming. You'll be fine with respect to this.
