Quick question everyone. We were married in the Philippines. My wife is visiting the US on a tourist visa for several months. Is it ok to start the process of filing form I-130 for a K-3 while she is here or do I have to wait until she returns to her country? I was thinking that it would speed up the process if I start it as soon as possible because by the time she returns to the Philippines we would only have to wait a couple months before she is approved for a K3 visa. Answers, thoughts and opinions are greatly appreciated!

The I-130 alone is not for a K-3 but for an IR/CR visa. K-3 requires in addition to the I-130 and I-129F. However, recent changes have made the K-3 all but obsolete. Plan on the IR/CR spousal visa.

The K-3 is obsolete? I thought Form I-130 should be filed first and then after receiving the Notice Of Action then I would have to File Form I-129F. The IR/CR spousal visa is something I have to research since I've never heard of it before. Thanks for the feedback!

So I did my research.. I can't get the IR1 visa since that's only valid for a marriage of 2 or more years. CR1 appears to take a bit longer than a K-3.

I have a friend they were married in Philippines then the wife got a tourist visa. she came here in the US a a tourist but the pettion is already filed in the philippines What they did is The wife didnt not return they just call the USCIS to inform them that the wife is here and ask if they can transfer the petion in US instead in PI!

So I did my research.. I can't get the IR1 visa since that's only valid for a marriage of 2 or more years. CR1 appears to take a bit longer than a K-3.

The K3 visa is considered obsolete since if both your I130 and I129F are approved at the same time, which they often are, the K3 will be closed when it reaches NVC.

Earlier the K3 was faster, now a days, not so much. And with the CR1 you don't have to worry about AOS after she gets to the US.

In my opinion you should go with the CR1, and yes, you can send the papers in while she still is visiting you,we did that and had no problems at all.

Since there is no K3, be assured CR1 is far faster than never.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

If so, are there any guidelines or specific intstructions posted here that I can follow to make sure she has all the documentation needed to interview for this visa. Thanks for your input.

People with immigrant intent are ineligible for non-immigrant tourist visas. Plan on you doing the travel until she has her CR1 visa.
