Timeline

I have been reading with much interest all posts/threads concerning the proposition of coming to the US on a K-3 and going back for the CR-1 interview. When the time comes, this really is a good plan for my husband and I.

So if he does this, does he have to have two separate medical exams, or will the first one count for both visas? If one will suffice, is there anything else between the two processes that can be shared, or will we have to resign ourselves to paying for duplicates?

For CR-1 Process:

CIS

08.17.06 - I-130 mailed to TSC

08.29.06 - NOA-1 generated

09.04.06 - NOA-1 received in the mail from CSC

09.11.06 - *Touch*

09.15.06 - *Touch*

11.01.06 - APPROVED!! [76 days]

NVC

11.20.06 - Case number assigned

11.21.06 - E-mailed Choice of Agent and mailed AOS Bill using James' Shortcuts

11.28.06 - Choice of Agent in NVC system

12.04.06 - IV Bill and I-864 Packet generated

12.06.06 - I-864 mailed using James' Shortcuts

12.12.06 - IV Bill rec'd via USPS and payment sent back to NVC same day

12.21.06 - I-864 in NVC system

04.12.07 - 10.30 AM Interview at London Embassy - in and out in half an hour!

04.13.07 - Visa arrives at Hubby's home in York, 1.30 PM. WOW!

04.29.07 - Husband arrives in US via Newark. :)

I think if you do it that way you have to have duplicates of everything. The AOS option in the US much more cost efficient IMO, as a second medical exam is not needed, and you don't have the added expense of a trip back to home country.

Hmmm. I guess we'll have to weigh things when the time comes.

After we send the AOS package and get the NOA1, we can apply for the EAD, right? And that takes about three months, according to the VJ guide. When he gets the EAD, he can work (and get a SSN), correct? How long does the EAD last?

Maybe as I learn more I won't think it's worth it to make the necessary accomodations to go back and finish a CR-1, but I've heard horror stories about the length of time people have waited for green cards in South Carolina. Are there any other Palmetto State residents here who can comment on this? Why does it take so long in one place as opposed to another?

Why does it take so long in one place as opposed to another?

Good question and something I dont know myself except that perhaps some Local Offices are backlogged as they deal with a lot more.

This is though why many choose to go back and interview for the CR-1. Whilst it may cost a little more, to many it far outweighs the often long wait for the green card, not to mention the wait for EAD. With the CR-1 this is all done and being in the US already on the K-3 makes the wait for the CR-1 immigrant visa bareable as you are together during the wait.

actually for a K3 EAD you DO NOT need an NOA from AOS. All you need is evidence that the I-130 has been sent in, which it has of course otherwise you wouldn't have a K3.

K3 EADs are for 2 years, and you can send the application as soon as you land and activate the K3. It can take up to 3 months for that to be completed and to get the SSN, so hubby will be sitting bored for at least that long.

Check the AOS timelines for Charleston, each district office is different of course, but with a 2 year EAD, there's probably not much to worry about.
