Hi! I am a USC and I filed I130 for my mom last month. I am just waiting for the USCIS approval so that I can get started with NVC. About 2 weeks ago, my mom's brother's petition to her becamse current. She received a letter from NVC and IV bill. My question is, will this affect my petition to her? We won't be using his brothers petion and will just wait for the approval of my petition. Do I have to do anything or call NVC and tell that we are not gonna use the first petition?Thank u!

We are not in good terms with her brother anymore. and Im sure they wont do the paper works.

If you're no longer communicating with that family member, maybe you should look into having the petition filed by the brother withdrawn so as to not have any confusion. I don't know if it matters but if your petition (for the same person, your mom) gets to adjudication, and she already has an approved petition in her name, wouldn't it create a situation where the already approved (and current) petition cancels out the one waiting to be approved?

I am not sure what paperwork you need to have him do... When your mom gets the DS-3032 just have her appoint someone else as there agent (ie. you)and you can submit the I-864
