please am bit confuse now i have sent out my doucments two weeks ago to american ebmassy .... and waiiting for my interview date, am going for k3 .. is it going to affect me since k3 is no longer availble ...... my wife file for k3 visa since May 2009, then Nov 9 2009 they sent my doucment to turkey's embassy in anakra ... please am bit confuse now, i don't know what to do .....please help me

K3 is still available under limited circumstances. Only if your I-130 and I129F reached NVC at the same time and after feb 1st 2010 then K3 will not be available. In your case it looks like they sent it to the embassy on Nov 9 2009, so if the embassy already got the K3 papers, then to me it looks like your K3 was not administratively closed by NVC.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.

K3 is still available under limited circumstances. Only if your I-130 and I129F reached NVC at the same time and after feb 1st 2010 then K3 will not be available. In your case it looks like they sent it to the embassy on Nov 9 2009, so if the embassy already got the K3 papers, then to me it looks like your K3 was not administratively closed by NVC.

Also there is a lot of discussion on this forum on which visa is better. You should probably do a bit of research and see what process(IR1/CR1 or K3) is best for your criteria in your case. In case you want to go with IR1/CR1 instead of K3 you should be easily be able to do that even if your interview is already scheduled.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.

Thank you for your reply am very greatful ..please in my own case what should i do ?should i wait and do the k3 since is been at the embassy nov 2009? and if i want to go for CR 1 ... What do i need to do ? how long is it going to take ? thanks waiting for your reply ...

How is it possible to still qualify for K-3 visa by avoiding the closing of the application after Feb 1, 2010 because of simultaneous arrival of I-130 and I-129F at NVC?
