2 RFE's :(

Timeline

So unfortunately yesterday I received 2 rfe's.... one saying that I didnt have enough evidence from the petitioner/sponsor for 1-864 and also, I need proof of medical. Should I just take my vaccination records to a civil surgeon nearby and get them to fill out I-693, since I had my medical done within the past year? Then for the other one it asked for employment letter, but my sponsor said her secretary isn't aloud to put salary on the letters anymore. So would it be sufficient to send past 6 months of pay stubs? Will this delay I-765 and I-131 as well, or just I-485? I am going to try and get everything sorted out this week.

Just out of curiousity, did you include the vaccination sheet with your paperwork initially? I'm confused as to why they wouldn't have your medical from the K-1 already... By proof of medical, do you mean they're asking for the I-693?

As for the support, did you include anything initially? Tax returns, and what not?

Sorry for asking questions that won't really help you. I'm just worried as I've recently submitted AOS as well. lol

It is supposed to state the salary - but if they won't give it to him....they won't - so the paystubs are better than nothing. I'm assuming you mean they specifically asked for a letter of employment.

Also, I just noticed you said you sent W2s - did you send the tax returns (1040s) as well?

(2) Job Letters and Proof of Income link

Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence. The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wage s or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect. Promises of future employment are not required.

I did send the vaccination record with mine... guess it didn't do any good... said i needed a medical. So they must have no receipt that anything was ever done.

Also, I gave W2's from past 3 years... guess that wasn't good enough either :(

If they won't give him an employment letter with his salary, ask for a letter stating the nature of his position and the hours he works. My husbands employment letter didn't mention his income at all, but it never caused us an issue. It did however state he was a full time employee and had been for several years. We also included all the pay stubs we had saved since our K-1 interview and tax returns from the last 3 years. It actually never dawned on me that the employment letter should state his salary, so maybe we got lucky. I'd get what you can get from his employer and include that plus as many recent pay stubs as you can find.

As for the medical, I've seen about 4 different medical related RFE's on VJ here in the last couple months. Could you maybe be more specific about the wording? In some rare circumstances they lose your medical, in which case the RFE says they have no record of a completed medical exam. If you were to show us exactly what it says, we could probably be more helpful.

I got the I 693 medical form done. I didnt want to risk an RFE. or maybe I should have! to buy time and I would've had my interview after my 2 year anniversary. hahaha

HI ya

i just got the same RFE;'S for the AOS..i contacted the 1-800 and spoke with a supervisor who said that this becoming a problem and they were flsgging it to the next level for investigation....they told me to write a letter stating where i entered, dates another copy of I-94 and request them to contact the border crossing to access the infomation. He said that some officersare unaware K1 medical information...

i am just sending them the letter that i wrote another copy of DS2035...and hope that flies..as for the payroll stuff, tax returns, w2 and a letter from my wifes employer...

let me know hw it go's...

it says... you have indicated that you last entered the US as K non-immigrant, please submit a properly completed and signed copy of the medical exam conducted overseas on from 2053... med exam for immigrant or refugee applicant, for the applicant on from I485.

If you do not have a completed for 2053, please submit a properly completed and signed from I693, report of medical exam and vacc record. the med exam must be conducted by civil surgeon....

have you heard of this one??? does this from have 2053 written on it.. i handed in the one that the doc filled out with all the dates of my shots. was this not correct??

I submitted ONLY the Supplemental Form to the I-693 (Documentation of Immunization) with my I-485 Application as specified in the Instructions for K-1 Fiancees. I still received an RFE for Medical Examination I-693, even though I had the initial DS-2053 submitted prior to getting my Visa. I had a copy of the DS-2053 sent to me from the Civil Surgeon "back home" and took that along with my copy of the Supplemental Form I-693 back to the US Civil Surgeon and then got my I-693.
