Confused - everyone is saying diff things - I-134 income levels?

Ok Im officially confused. People are saying different things in regards to HOW much you actually have to make for the I-134 affadavit of support you need to send to your fiance overseas for the K1 visa.

Is it 100% or 125% for the I-134?

I dont make enough for 125%, so I will need to get a co sponsor for the I-134...right?

The confusion comes from the fact that each consulate seems to apply different standards to it. While the I 134 itself calls for 100%, many consulates - London included - still look for the 125% to be satisfied. The logic being that the 125% will have to be in place once the immigrant enters the US and is adjusting status (via the I 864). So being a London-ite, then yes, I'd line up a joint sponsor.

Generally the 100% is for active duty US military who are petitioning. The 125% is for all other sponsors who are petitioning.

It is 100%, however as TracyTN mentioned, that figure can also be consulate specific.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

how many in your household?

for me i am one and i am having to show about 15000 in income. i also will have my cpa show my assets and net worth. since i am selfemployed this will show where all my money is and i have lots of tax returns showing where most of my ture income arrives from

so it depends on the number of people in your house, right now and if they will add spouse to it, to be honest, if you have a family size of 2 your fine. if you have a family size of 4 you need sponser and asset sheet.

You household size will not be 1. It will be at least 2 for the K-1 visa--you and your fiance(e).
