I'm sorry to ask such a basic question but I am applying for a job overseas and they are asking me if I've ever been charged with a crime in any country. I am Canadian living in Canada and received an expedited removal from the US 6 years ago under 'fraud/misrepresentation.' I never applied for a waiver as I have no wish to return but I'm now wondering if this constitutes a crime.

I don't believe it would be considered you were "charged" with a crime. (indeed, expedited removal usually means you didn't even go before an IJ).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

To be more specific, there are two questions: 1. Have you ever been found guilty of a crime in any country? 2. Are you currently the subject of any criminal proceeding?

An expedited removal wouldn't fit under either of those two, would it? Hopefully I'm just being paranoid but I've learned that it's much better to be careful...

Pretty sure it doesn't fall under it.

Ask yourself, were you in court? did a judge state your guilty? did you pay a fine or server time?

Are you required to go to court for this? Is there a case against you now?
