As of now, I still dont have my petition back here. The NVC has not gotten it, USCIS does not have it.... its out there somewhere. I called, nobody knows where it is.

Now, my petition expires on April 11th. We have decided we want to refile. How soon can I do this ? Can I do this now, will it cause a confusion at VSC since in the computer I still have this one saying approved.

This is what happend to me today when I called USCIS.. they are asking me.. Whyyy do you want to withdraw if you have an approved I-129F out there. They did not get the part where I explained, its being sent back and I said it twice.

Anyway, is anyone out there experiencing the same situation. Did you refile, withdraw any tips I would appreciate.

I don't think you are getting any responses on this because its not clear what is happening. Do you have an NVC number? Have you paid all fees? Sent from whom to whom and why would they send it back to you?

If you just have an approved petition from USCIS and hadn't paid fees entering into the NVC process, you might be able to "activate" your case by paying a fee or emailing NVC ?

I am doing a K1 so this works a bit different.

I have a feeling sending back a petition takes longer then expected... I read from other peoples expiriences it can take weeks.. months.

I paid everything I had to pay.

They are sending it back to NVC cause my petition got DENIED.

11/10/07 married my SO

1/5/08 trip 2 DR for 10 days

7/10/08 DR for 10 days

8/23/08 mailed I-130

8/29/08 USICS in Vermont accepted

12/22/08 Case transfered to CA Service Center

12/28/09 DR for New Years and Birthday

1/28/09 Received SDO #

2/4/09 Paid AOS fee

2/20/09 Trip to DR

2/26/09 Sent Choice of Agent Form

4/4/09 IV fees paid

4/20/09 Sent DS230

5/1/09 Missing correct BC

5/5/08 Supervisor review

5/18/09 Case Completed

7/29/09 Called NVC found out about CITA

9/9/09 CITA...Placed on AR

9/13/09 Came home to the US alone :(

frontloading the new petition may and I say may, avoid the NOID... but there is a good chance you will get a NOID and have to address it.. The NOID would be a result of them getting that first case back to USCIS already... if the case is not yet back to USCIS, they may let the new petition slide through fast.... having the evindence of bonafide included in the initial filing is a great thing when there was a doubt before.. they can tend to refuse to look at evidence and say you never provided it at the consulate... they cant hold something against you that USCIS has documented as being evidence submitted already...

I just noticed that your first case is reaffirmed.. great news! lets hope the evidence from the new one gets to the consulate along with the old case......

I would think I am past the NOID since my case got reaffirmed and is on the way to Brazil.

Now lets just home the 2 cases can be merged together.
