Hello,

My wife and I sent the I-130 papers on September 2009 and received NOA1 on Sept. 28th, 2010 as of today, we have not received any more news (It has been 6 months already). Today, we filed a service request in order to understand what is happening.

I have been interviewing with a company and they want to hire me, the problem is that I do not know when the green card will be ready. I do not know if have any other options or if I am required to wait until the CR-1 process is done (whenever the USCIS decides to finish reviewing my case) and most likely loose this opportunity.

I am wondering if I could get any other kind of visa? Let's say TN since I am a mexican citizen? Can I expedite the process using premium processing?

Hello estrellademiel and visajourney members,

My wife is a US Citizen. We have been contacting USCIS a lot but we have not find any good answer, they just say that the case is in "initial review status" and they do not have any further info. They told my wife that once our case had 30 days more than the national average, we could file a service request. We just did that and they said they would get back with information within the next 45 days which is a lot of time.

I have found her congressman information on the internet. What is the process to contact him? Do you have any pointers that might help?

You cannot get a TN visa because this visa is a non immigrant visa - you cannot have any intent to immigrate. If you do, ,they can pull your visa (then you have no status) plus you may face sanctions. Moreover, because you have an I 130 in play, that shows you have intent to immigrate so TN1 visa is not an option.

You may wish to call your congressman or woman's office to inquire as to the hold up on your case.

You may try to get your employer to do an H1B visa but you have to see what level/priority a worker you would be ie professional degree, advanced degree, labourer etc. And depending on the type of employment you might be in, the H1B visa is usually showing a deadline of April of each year and if granted, you come in October of the year. However, if your employment has any links to universities and practicum you may be excempt. That might have confused you if you are unsure of H1B status but you can google this or research H1B to see what that means.

You're best bet may be to try to get to the bottom of your delay and that may require the congressman's helps.

There isn't a lot you can do until the CR1 moves. You are still several months away from being here even if it is approved today. You should ask if they will have the position open in a few months. That is the danger of looking for work when you aren't authorized.

This will not be over quickly. You will not enjoy this.

Several updates regarding this case.

1) We have contacted the Congressman and we filled a form to allow him to ask about the status of the request on our behalf.

2) We called USCIS and requested information as the process was outside normal processing times. Below is the answer:

USCIS electronic records indicate that your application/petition was filed on September 28, 2009 and is currently within current processing time. We are currently processing cases filed on February 02, 2007.

I think that there is a big problem and something should be really off. According to the USCIS website CSC is taking 5 months to process this case (I130) but the email they sent says that they are in the normal timeframe.

DO you have any ideas? What can I do to move this thing? Am I did something wrong?

That is the stock and standard USCIS response to any requests. They will always tell you that it's within the five months blah blah...I think you did the right thing by contacting the congressman's office and completing the release of information etc and let them inquire further on your behalf. They have the ability and political clout to cut through some red tape, at least in terms of inquiry into the matter.

Wait for your reply from them and /or follow up if you haven't heard back from the congressman's office. Did you discuss with them how long until you may get information from their office?
