Just when I thought it was finally over and starting to forget.....

I receive an email stating that my I-129F is now being forwarded from the Manila US Embassy to the STATE Department...???

Actually, i forgot maybe being lazy did not send a cancellation letter....which I am typing now. :bonk: :bonk: :bonk:

Just wondering if anyone else who did not cancel the Petition after the Beneficiary "Failed" the interview has similar experience?

I just wondering why this Petition did not terminate itself since the Beneficiary is "NOT ELIGIBLE" for fiance visa....

and what is the point of sending it to the STATE department

Would it help to know that the Embassy/Consulate is part of DOS? "Manila US Embassy"

At any rate, eventually the approved petition (and I suppose denied visa application and related 'stuff') will make its way to USCIS.

Just to play it safe now.....I am sending a copy cancellation letter right now to all 3 addresses....

Manila US embassy......

Original USCIS address.......

and the State Department.....(if i can find an address anywhere....lol)

The file doesn't stay at the embassy. When the beneficiary "fails" the interview, the embassy has to send the file back to the NVC. The NVC logs the file in and then forwards it to the original USCIS office that approved the visa.

Cancellation letter sent to the USCIS......

My concern was why it went to the STATE department....

i just hope that this will not "cause me problems" since SHE LIED to me and everyone else involved....

Don't worry about it going to the State Department...that is normal procedure. The embassy cannot keep the file indefinitely. The NVC is part of the State Department. If you go to the NVC website, you will see. I have enclosed the link. I hope this gives you some sort of piece of mind. Plus, you can always call the NVC and ask them about it.
