Hello Everyone I am a New at this forum and need some guided help. My girlfriend and I have been dating long distance for almost two years.I meet her on a visit to Germany. she has visited me once in the US and I have been there three times in the past year and a half. I am a US Citizen. We planned on getting married, but I really don't know what is the best way of getting her here quick without the long wait. She also has a 9year old daughter who will be coming with her. Do I file the I129F form and marry her within 90 days when she gets here? how long thus the initial paper work take to be approved since I am planning on getting her daughter to school as soon as they get here so not to keep her home for a long time because of the school calendar year. I know there are two options to go about this but don't know which is best and fastest. thank you[/size][/size][/size][/size][/size].

I think the K1 route is quicker, but I am not sure.

You file for both your fiancee and her daughter on the I-129F.

Do I file the I129F form and marry her within 90 days when she gets here?

It's a bit more complicated than that. You file the I-129F for her and her daughter, if it's approved it goes to Germany, they will contact her for a medical for her and daughter, she gets police certificates, fills out a visa application for her and her daughter, attends an interview, if approved they come w/in 6 months of approval and you must get married within 90 days.

how long thus the initial paper work take to be approved since I am planning on getting her daughter to school as soon as they get here so not to keep her home for a long time because of the school calendar year.

It's safe to say 6-8 months start to finish, barring no complications, delays, etc.

K1 and K2 is the fastest way to get them here because you can file now instead of waiting until you're married. "Get her here" fastest or not is not the whole story though. You must get her here, keep her here and get her work authorization and then later keep her here longer (remove conditions).

If you bring her as your spouse, the first two steps are combined, so she arrives as a permanent resident authorized to work and so does the daughter. I recommend weighing your priorities, making the life decision that best matches your priorities and then following the immigration process (fiancee or spouse) that matches your life decision. Hopefully, life is long and the immigration process is short in comparison.
