Hi all, my fience cousin is here in the US on a J1 visa and ask me if she can get a green card. How does this work? I dont know if she has the 2 yr HR requirement or not if so she would have to get a wavier and then apply for AOS? what would she need from her employer? any help on this would be great. How hard is it to do AOS for a J1? Thanks in advance.

Is she planning to marry a US citizen or just wants to stay after her J1 expires?

My understanding is that it will say on the actual visa if she is subject to the section 212 (e) home residency requirement or not.

There is no visa-to-Green card process for fiances. The visa she needs is the K-1, but it cannot be issued to somebody who already lives in the US.

First thing is to learn if there is a home residency requirement. If yes, then she must leave the US and reside in the home country for the 2 years.

If no, an employer must petition for a work visa and demonstrate that there is no one lawfully able to work in the US that can accept that position. Given the current economy and unemployment rate that will be tough.
