I need some help to calm my nerves.

Me and My wife are soon about to send our AOS forms but i have a question.

We used to have a sponsor to secure the petition, but now that sponsor pulled out, i now want to know if we still have a chance, she now earns more that enough to cover 125% poverty line, but she hasnt earned enough the last few years. Will this be a problem ?!?!

Form I-864 (signed and dated)

2009 Federal Tax Return/W2 and 1099s.

2008 Federal Tax Return and W2 and 1099s or IRS tax transcript.

2007 Federal Tax Return/W2 and 1099s or IRS Tax Transcript

Letter of Employment.

Pay stub(s) from the most recent six months.

Bank Statements.

I just started making enough to sponsor my wife last year and we filed in January (prior to doing 2009 taxes). Our lawyer told us that present income is what is important and not to worry that I didn't make enough in previous years. We did include a letter from my employer stating my current wage and work hours and estimated annual salary. We had to send in the paperwork from the last 3 years (including a year where my taxable income was actually negative), but only the current year matters according to our lawyer. So, send in all the info and then some documentation of her current income and it seems like you should be fine if what my lawyer said is accurate (and she's extremely experienced with immigration issues for people living in poverty, so I think she knows what she's talking about).

yes, she is currently making enough annually, but she havnt worked a year yet and she is filing her taxes today

Current income is considered first. Past income is used to show stability.

Follow the advice in sciencenerd and schinky's posts and you should be ok.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

hello everyone, i need help. i think i did mistake,tell me what to do next?

as per vj's guide ,i send my aos i-864 package to nvc after my aos fee shows "paid"

but my mistake is i send i 864 package below address as per cover seat address.

address is

32 rochester avenue 31 rochester ave,suit 100

Portsmouth,NH instead of portsmouth,NH

and also

i send via certified mail but forget to add returen with signature.

i send aos on 03/23/2010 and today is 03/29/2010 but i can't see any moving on usps website track&confirm.

i called usps and they said they deliever almost 2000 mail in portsmouth buiseness center and they don't have scanner for that.

so i m so worried because of my two mistake, send on different address and didn't add signature service(actually forget)

so tell me guys ,what should i do next? wait or should i send it again and which address?

please tell me , i am waiting for reply.thanks you fro your quik reply

THANKS SACHINKY. FEEL BETTER BUT STILL LITTL WORRY. BCAUSE AFTER THAT MAIL(I-864), I SENT DS 230 AND WITH IN COUPLE OF DAYS IT'S IN SYSTEM UNDER REVIEW BUT IT'S BEEN 10 DAYS I SENT MY I 864,AND NTHNG HEARD ANYTHNG IN AUTO MASSAGE OR BY REPRESANTAVTIVE WHILE I TALK TO THEM. I SHOULD SEND I 864 WITH RETURN SIGNATURE SERVICE .ANYWAY THANKS FOR REPLY.AND JUST WANNA KNOW AFTER CASE COMPLETED ,HOW CAN I GET INTERVIEW DATE? CAN WE CHHOSE SPECIFIC DATE?

ya i talked to an operator, but she said they get more than 2000 mail /day so she didn't know yet but she said there is a biogrphic form on its way from the petitioner and it's under review. so i don't know what that mean. because i sent i 864 first and then i sent ds 230.i know ds 230 already delivered because that shows in usps tracking............... so still worry about i 864.
