The following is from the Social Security site and posted in a vj guide. Does this mean that several classes of visa, including the K1 Fiance, can work for the first 90 days after entry into the U.S. without an EAD?

"Aliens Work Authorized Without Specific INS Authorization

The following lists nonimmigrants, by alien classification, who are authorized to work in the U.S. without specific authorization from INS. The alien’s I-94 will not have the INS employment authorization stamp and the alien will not have an EAD."

Feb. 2005 - Met in Brazil the first time

May. 2005 - Visited Brazil

Aug. 2005 - Visited Brazil

10/30/05 - Mailed I129F

11/09/05 - NOA1

Nov. 2005 - Visited my fiance in Brazil

02/02/06 - NOA2

Feb. 2006 - Visited my fiance in Brazil

02/24/06 - Packet received at NVC

03/20/06 - Fiance received packet 3 from consulate

04/26/06 - Fiance received appointment letter

05/09/06 - I flew to Rio

5/10/06 - Met fiance at airport

5/11/06 - Medical exam in Rio

05/12/06 - Interview in Rio - APPROVED!!!!

05/17/06 - Received visa in Rio

07/20/06 - POE Miami

10/16/06 - Married!!!!

01/10/07 - Sent AOS and EAD application

01/17/07 - NOA - Receipt

02/02/07 - Biometric appointment

02/09/07 - NOA - Transfer of case to California center

03/22/07 - EAD approved

05/10/07 - AOS approved!!!!

The EAD is required to evidence the authorisation.

Yes, my understanding is that you are correct. A K1 is authorised to work for the first 90 days.

The unfortunate thing is that you are unlikely to get hired without the EAD stamp from the POE (offered at JFK), because you're unable to fulfil the requirements of the I-9. You can't prove that you're work authorised.

You also have to stop working between the end of that 90 days and the receipt of your 1-year EAD, which makes it less than worthwhile for many people.

Hi, i only knew that if your POE as K1 was in JFK, they give EAD stamp in your I-94 means in the duration of your 90days u are allowed to work and u could applied SSN in ur maiden name, after that 90 days ur EAD already expired.

But if uve been just given only I-94 as u entry... ur not allowed to work even you apply for SSN in maiden name. U could only work when u sent EAD application and its been approved and gave ur EAD card.

Another case is, ur not allowed to apply SSN after u married ... bcos u need to wait for ur EAD application approved first ... before they let u apply SSN in married name.

That's all i knew .... since im not too eager yet to work, i didnt apply for anything until i go approval of my EAD & my AOS application, after i get my EAD card then i will apply for SSN in married name.

You are allowed to work because work authorisation is inherent to the status, you just can't prove it. Realistically, that means that your only option is to wait.

Once again that is SSA procedure for assigning SSNs and issuing SSN cards, so I wouldn't take anything from the SSA Website as giving you authorization to work.

This is what matter:

Sec. 274a.12 Classes of aliens authorized to accept employment.

(a) Aliens authorized incident to status. Pursuant to the statutory or regulatory reference cited, the following classes of aliens are authorized to be employed in the United States without restrictions as to location or type of employment as a condition of their admission or subsequent change to one of the indicated classes. Any alien who is within a class of aliens described in paragraphs (a)(3), (a)(4), (a)(6)-(8), or (a)(10)-(16) of this section, and who seeks to be employed in the United States, must apply to the Bureau of Citizenship and Immigration Services (BCIS) for a document evidencing such employment.

(6) An alien admitted to the United States as a nonimmigrant fiancé or fiancee pursuant to section 101(a)(15)(K)(i) of the Act, or an alien admitted as a child of such alien, for the period of admission in that status, as evidenced by an employment authorization document issued by the Service;
