Getting an ITIN number for my spouse

Hey all,

I'm not sure if this is the right forum for this. If it isn't, can someone please re-direct me? I know I put a similar question to this in another area, but didn't get to the bottom of it. Ok...so here goes...

I am trying to get my wife an ITIN number. We were married in October and are waiting for the CR-1 to be approved. She is sending me a notarized copy of her passport. Is this all I will need?

I was told that she had to try to file for a SSN first, and then once she is denied, I need to include the letter of denial with the W-7. I haven't seen this in any literature I have read on the IRS site or any of the ITIN walk-throughs I have read. I want to make sure I get this right the first time. Does anybody know if I'll need to provide this letter of denial, or will the passport be suffecient? Thanks in advance for any help folks, I'm starting to get a big headache from doing the research myself, so I thought I'd try again to request help from the professionals. Thanks again.

I just send the W-7 for my wife last month. All you need is the Notarized copy of her passport, She needs to sign the W-7 and the tax return, you need to send all this and your tax return to the w-7 office. I also personally send her birth and our marriage cart. as well as the 1-130 NOA1. I had all the paper in one file so it was easy for me the make copies off all these paper. You don't have to do this but I am just telling you what I did. Also note that it is going to be awhile before you get you tax refund if any. IRS told me it's 6-8 weeks for the ITIN number and another 4 weeks for the tax return another 2 weeks since it was paper filed and I can't do a direct deposit. It looks like I will get my NOA2 before I get my tax return back...lol

4/19/2010 - NVC email confirming "Choice of Agent" email (~5 days)

4/20/2010 - NVC email with AOS and IV bill

4/23/2010 - AOS fee paid & package send

4/26/2010 - IV fee paid

5/21/2010 - IV pack mailed to NVC

5/28/2010 - NVC received IV packet

6/10/2010 - SIF & RFE (for PCC different for Sir Lanka)

6/11/2010 - CC (with RFE)

Wow, you guys are quick! So the plot thickens a bit....my wife went today to get her passport notarized by the US Embassy in the Philippines, and they said they can't notarize it without direction from the IRS. Does anybody have any idea what this is referring to or how I can supply the necessary documentation?

She needs to get it a Authenticated Copy which is done by DFA which is the organization that created the passport.

We had to do that last year. It was a pain but worth it.

Wow, thank you so much!! I think that is very helpful information! If I get that, I don't then need to get it notarized? That will take care of all the requirement for this document?

The W-7 form, in her hand, given to the USEM, is enough for 'direction from the IRS'.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Correct. That is what I used last March for our taxes. I tried to get it done at the embassy.

The info on DFA can be found at: http://dfa.gov.ph/main/index.php/consular-services/authentication

In DFA it is also known as getting a red ribbon. This is because the document will actually have a red ribbon attacheed to it.

The W-7 form, in her hand, given to the USEM, is enough for 'direction from the IRS'.

It does not work that way in the USEM. I have been there and tried that. Here is the info on the USEM website http://manila.usembassy.gov/wwwha005.html :

"W-7 Application

The Embassy Consular officers can authenticate originally signed birth certificates and marriage contracts issued by the Philippine National Statistics Office (NSO) (Obtaining Public Documents) in Quezon City, Philippines in support of applications for US taxpayer ID numbers, ITIN (W-7) application (Tax Assistance). Other documents required by the ITIN (W-7) may be certified by the issuing agency or official custodian of the original record."

The passsport is issued by DFA so off to DFA you must go.

I just did this exact thing but IRS reject it!

I'll call them up and find out what the hell is going on. grrrrr
