I brought the story here to ask what the other people think about her situation and how I could handle it. I didn't bring the story so you that I don't know at all, can say that I am not a good friend... Well, think what you want, I don't know why I reply, cuz I don't give a damn sh*t... If you don't understand why this situation is annoying for us, I can do nothing for you.

You bring it on the net and invite opinions, don't be shocked when you hear things you don't like. You're not being a good friend to this woman. That's my opinion.

We all were on a vj at one point or another...I more than understand how awful the waiting is. But judging your 'friend', talking about her behind her back, reveling in her misfortune, etc...is not gonna change your wait time.

She made it at JFK no problem ! You see, it is very easy to immigrate to the US... She will adjust her status before the end of April.

Well, she may get lucky but she isn't out of the woods yet. She has to prove that she entered the US without the intention of getting married and adjusting status.

If I understand the story right, she recently entered. If she is adjusting status by the end of April, she is going to get married very soon after entry. From what I have heard, a very short time between POE and marriage is one of the red flags that makes it very difficult to adjust status based on the marriage. That is, it's on her to prove that she wasn't intended to stay when she entered and that something within those couple weeks between entry and filing for AOS changed her mind. That is an uphill battle.

I'm still hoping for a happy ending to this one.

Well... No. The story is :

She entered the USA in feb, stayed til beginning of April with a brief stay in Mexico in the middle. Just before to leave the USA she got married (3 weeks ago). Then she went back to Europe for a couple weeks and cameback this morning in the USA without K3 or any sort of visa. She will stay in the US now and adjust status. I was wondering if even if they let her enter the country today, can it be a pb for her AOS that she cameback without K3 ?

Oh, I was wondering something, and I thought about it a couple times... When you go to the USA with a waiver. You stay 1 or 2 months then you go to Mexico or Canada for a couple weeks and you re-enter the USA to get married. Is Homeland security count all of your trip or just count from the last time you pass the border ? I know that if you stay in the USA 3 months and then you go to Mexico or Canada for a couple weeks and go back to the USA you overstay anyway but what about getting married ? Does the immigration says "Oh you get married after 3 months" (counting the Mexico trip) or "Oh you got married after 2 weeks" (counting the days after yu re-enter in the USA ?

Don't really know if I am clear... :blush:

It sounds like the AOS interview will be interesting.

K-1

March 7, 2005: I-129F NOA1

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Hey, the last question is not because I care, it is because I am curious. I gave up on her immigration drama, I just came back here to let ppl know that everything went well at the POE that's it. So if ppl know, I would like to know also how it works.

I am not worried for her, and I won't celebrate cuz I am against all immigration fraud and this is not a good friend. She is friend with one of my best friend here. Oh and by the way, why the laughing emoticons, that was not very funny, that was lame...

I know for you it's not funny because she got back and you were getting really to laugh with the others who "wished her

the best return in US". And stop talking about immigration fraud until you have proof of that (there is something called

libel if you never heard about that...).

I hope that she gets the last laugh just because you are too annoying...I also hope that God will give you more wisdom...

Um is this not immigration fraud punishable by prison. Or has everyone gone all (low class) ghetto with this anti-snitch attitude.
