Hello all,

My wife is a conditional resident and we're coming up on the 2nd anniversary of her arrival in the US. She's very secretive about her finances; has not cooperated with me on the income taxes and it looks like I'm going to have to file separate tax returns this year. We also don't have any joint bank accounts. On the plus side we have a child together.

In the absence of evidence of financial intertwining, will the presence of the child persuade USCIS that we have a "good faith" marriage?

You should remind her it's she whom the USCIS will be judging, not you. USCIS will be assessing the co-mingling of funds and other daily living attributes, they will be looking for things such as but not limmted to, i.e Insurance(health, car,life), bills,mortage or rent leases etc. Please refer to the ROC in the forum section for a more detail listing.

It's okay to file taxes seprately, but you both must have filed as married.

No a child alone does not prove a marriage was entered into good faith. According to USCIS it just proves that you'll had sex one night.

The main question you should be worried about is if SHE entered into marriage WITH YOU in good faith. Why wouldn't she file taxes with you? Why wouldn't she want you to know how much she makes? Where's her portion of the pay checks going? Why is she being secretive with her money? Let her understand she's the one who needs to remove her conditions so the early she coorporates, the easy I-751 will be for her. Unfortunately, having a child doesn't trump all according to uscis. People have babies all the time but comingling of finances is not easy as you can attest to that fact. They want to see you have a marriage outside the bedroom as well.
