I went to the Philippines and escorted my then Fiance back to the USA on a fiance visa K-1. We arrived in USa at Port of Seattle on Nov 12, 2009. We were married Jan 19. 2010 in the USA. I asked on visa journey about the 90 day filing of the AOS and was told that USCIS would "forgive" the late filing after the 90 days, as long as it is handled in about six months. I've read the requirements, but some of it is still confusing. From what I understand we need the I-485, I-785, and I-140 for alien work. Is the cost for all filed together 340.00 or the 1010.00? I'm assuming after the paperwork is sent through that USCIS will set up an appointment for us. What's up with going to see a civil surgeon??? I'm confused. Anyone able to briefly explain the process so I have a better understanding of this procedure? Also feel free to send me a message. Thanks!

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

From the AOS Guide;

The fee for I-485 applications filed on or after July 30th 2007 inlcudes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007).

the forms for AOS are I485 (applicatio to adjust status), I765 (EAD or application to get authorization to work while waiting for result of AOS approval/greencard) and I131 if she has plans to leave the country while AOS application is pending.

Since my Wife is now "out of staus" because we are past the 90 days, do you see any issues with ISCIS, as long as we get the paperwork turned in within about six months? There was no way we could have had it submitted within the 90 days, as we run close to that getting her here. I have been told by many on here the 90 days thing will be forgiven as long as it is submitted with the fees within about six months, even though she is now "out of stauts". Any ideas??? Thanks

Stop worrying. File the documents and then NOA1 you receive acts as the temporary visa. She should not leave the US until the GC or AP are in hand but you will be OK.

Also Read the Guides because it is clear you haven't because you are citing costs and document numbers that are not correct. (485, 765, 131, 864, 325A should be on the list).
