Just a quick question that I hope some of you can help me with. My fiancee in Taiwan has received the first package (3) from the AIT stating that she needs to fill out DS-230, DS-156K, and DS-156. I looked at the example form provided here and it makes it a little more confusing. Question 36 asks if someone has ever filed a visa petition on your behalf, and the answer is no. Shouldn't it be yes, since someone IS filing a K-1 visa petition for the person? This is confusing, is it a typo or does my fiancee really have to put NO even though I'm filing the petition on her behalf? Thanks for your help everyone.

I put yes, and put my finacees name in the box.. seen as YES someone had filed a petiton on my behalf.

I dont know if this is correct but i am sure many get confused over this question so i am sure they will expect both yes and no answers.

I assume you are asking about Question#36.

The answer is: NO

Beacuse it asks about an immigrant visa petition.

K-1 isn't an immigrant visa. It's somewhat a dual-intent visa, but it's classified as non-immigrant for all purposes. Thus the answer is NO.

Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry an American citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa."

Well I'm not to this point yet :( but I did find this. And now I am a bit confused as well!

The K-1/K-2 is a NON-immigrant visa. The K-3/K-4 is an immigrant visa. Note the words..."must meet SOME of the requirements of an immigrant visa." These types are somewhat similar but not the same.

03.23.2010 NVC sent file to U.S. Embassy in San Jose, Costa Rica! SNJ2010XXXXXX

03.26.2010 Received NVC letter (hard copy) dated March 24, 2010 in the mail.

03.27.2010 File arrived @ U.S. Embassy.

04.07.2010 Embassy called for Elsie to come and get Packet #3. She will pick up April 13th.

04.08.2010 Embassy e-mailed Packet #3 to me today.

04.15.2010 Interview scheduled for 30 April 2010

04.30.2010 Visas approved...pick up everything on 5/4/2010 @ 3pm.

05.05.2010 Traveling together to the USA...POE Denver, Colorado

07.28.2010 Married today...end to a long journey with more to come!!

The K-1/K-2 is a NON-immigrant visa. The K-3/K-4 is an immigrant visa. Note the words..."must meet SOME of the requirements of an immigrant visa." These types are somewhat similar but not the same.

Okay so just to clarify, question 36 would be NO because the finace visa that I apply for is NOT an immigrant visa but a NON immigrant? Just want to be sure :)

At Vancouver, Canada, last April, for the DS-156, Question 36, I put "No". Worked fine for me.
