AOS - Made a mistake on the pay to

Hello. I would just like some helpful advice. Please do not criticize me as we all make mistakes. I am usually very meticulous in preparing my documents. In my haste to get my AOS done, I inadvertantly put USCIS on the cashier's check, rather than The Deptartment of Homeland Security. I didn't carry the instructions with me to remember who the check should be made out to. I don't have a problem if I get an RFE, thats okay. My concern is should I place a stop payment on the cashier's check (can I do this?) or will they return the check to me? My biggest concern is getting the 1010.00 back not whether or not I get an RFE. I will put on big girl draws and address that part. I just don't want to lose my money. Thank

I think if there is a basic problem with your initial submission...didn't include I-485, didn't sign form, didn't include a check or for wrong amount, check not made out to Homeland Security...they will mail your whole packet and check back to you. It's like they reject the whole thing (in some instances) before they start working on it or deposit the check. So you can do another check and send your packet straight back to them.

Don't get the bank to issue a stop-pay. If USCIS doesn't like the 'pay to' they'll send the whole thing back (they're not going to keep the money but say you did it wrong). :star:

Thank you! That was my main concern is just getting the money back. I will deal with it accordingly. Thank you so much for your help. I appreciate it.

Oddly enough, I did make my check payable to the U.S. Department of Homeland Security, and they stamped "United States Citizenship and Immigration Services" over it on the check. I've never seen a check clear after someone has changed who it is payable to like that, but there you have it.

Technically USCIS is part of DHS, so I can see how they could justify it.

Of course. I'm not complaining, I just think it's odd that they have someone actually stamp USCIS over US Department of Homeland Security on all the checks. Seems like a waste of time to me. Anyway, as long as they're processing the application I'm happy.

It's probably more like a machine stamper/endorser (not an actual person). B-)
